HomeMy WebLinkAboutFindings of Fact FINDINGS OF FACT SHEET—DEVELOPMENT STANDARDS VARIANCE CARMEL ADVISORY BOARD OF ZONING APPEALS (Petitioner to fill out 1-3 + first two blanks) Docket No.: PZ-2023-0226-V Petitioner: Jeremiah & Nessa Hamman 1. The approval of this variance will not be injurious to the public health,safety,morals and general welfare of the community because: The proposed height of the building will not be injurious to the public health, safety, morals and general welfare of the community because the building is complimentary to and commonly associated with residential use. Also, the building will be designed in a tasteful manner to enhance the property. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The use and value of the area adjacent to the property included in the variance will not be affected in substantially adverse manner because the surrounding areas closest to the property also enjoy the benefit of accessory buildings some being large and tall in height. The location of the building will not interfere with the surrounding properties and will be well screened with existing and additional landscaping. Further, by housing the pickleball and basketball courts indoors will limit noise which is an added benefit to the surrounding owners. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: The strict application of the terms of the UDO will result in unnecessary hardships in the use of the property because without the variance, the Petitioner would have to deviate from the overall plan for the property. Specifically, the Petitioner would not be able to adequately enhance the property with indoor recreation and additional garage space. that is needed to remove now stored outdoor vehicles inside and improve the appearance of the overall property. The hardship exists because the UDO limits the height of accessory buildings regardless of the type and use of building. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. PZ-2023-C6-V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
