Explanation of Special Use Amendment Request
Petitioner seeks an amendment to its approved Special Use application for an automobile
dealership to be located on the north side of 96th Street, two properties east of Randall Drive. The
building plans approved by the Board of Zoning Appeals in June of 2000 for the automobile
dealership indicated a masonry block and brick exterior on the rear portion of the west and east
elevations and the entire north elevation. The petitioner requests approval to change the block
and brick exterior to precast concrete panels, which will be substantially the same in color and
appearance to the block and brick.

FINDINGS OF FACT - AMENDMENT TO APPROVED SPECIAL USE APPLICATION
1.
The Special use is not located in a Flood Plain District subject to Ordinance Z-160, Section 21.06 as amended.

2.
The approved Special Use for the site (i.e. an automobile dealership) is not being modified. The Applicant is only
requesting a change to the approved application to allow the Applicant to revise the building materials.

o
3.
The Special Use with the revised building materials continues to be physically suitable for the land in question.

4.
The Special Use with the revised building materials will not injuriously or adversely affect the adjacent land or property
values.
u
5.
The Special Use with the revised building material will not adversely affect vehicular or pedestrian traffic flow, nor the
adequate availability of water, sewage, or storm drainage facilities, or police or fire protection.
o
6.
The Board has reviewed the requirements of Ordinance Z-160, Section 21.3 (1-25) as they relate to this Special Use, and
does not fmd that those criteria prevent the granting of the amendment to the approved Special Use application.

IT IS THEREFORE the decision of the CarmeVClay Board of Zoning Appeals that Special Use Docket No. SUA-76-0l is
granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part
hereof.
