FINDINGS OF FACT. DEVELOPMENTAL STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The proposed signage will be constructed in accordance with established design
guidelines and will becomparabl~ to other signs in the area. Signs of this
type are commonly constnucted within the City of Carmel.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
Adjacent properties are of like use. Proposed sign will not infringe on
adjacent properties nor impa iT vistbi.'lity of ~djacent owners signs or buil dings.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
Stiict application of the ordinance appears to be inconsistent with the City~s
desire for visual continuity within the development, as well as,"puting the
tenant of this outparcel at a compettti,ve disadvantage with netghbori'ng
businesses.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Developmental Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.

O'Charley's resmurant is very much looking forward to becoming a part of the Carmel community. The
Carmel store will be the 164th in the O'Charley's chain, and one of only three in the country with this
particular configuration. As part of the Merchants' Pointe development, O'Charley's has worked closely
with the Linder Company and the ADLS board to design a project that fits well within this shopping
center as well as the surrounding neighborhood. Part of this overall plan includes monument signage
for the outparcels along I 16th street. We feel that the overall layout of the three outparcels on the
street, utilizing landscaped parking islands, lends itself well to the placement of signage for each
outparcel, thus providing all tenants with equal opportunity for recognition by the public. I believe
that even some members of the ADLS board have expressed their agreement that regularly spaced and
uniformly designed monument signage would be consistent with the quality of development.
At present, O'Charley's is restricted to only having the two building signs because of the number of
street frontages the building has. We feel that it is a reasonable accommodation to our client to allow a
third sign in the form of a monument sign, given the reasons set forth above. We respectfully request
that the board grant this petition for the construction of a monument sign.
