Dear Mr. Malloy:
Our office has reviewed the Developmental Standards Variance petition filed by yourself on
behalf of 0' Charley' s, Inc., for Merchants' Pointe, Lot 2. The following are comments that need to
be addressed:
Application:
· Your letter dated August 9,2001, lists a letter from The Linder Co. as one of the items
included in the application materials. This letter was not received. Please forward a copy
immediately.
· The Legal Description provided as Exhibit A appears to describe Merchants' Pointe in its
entirety. Please provide a description of Lot 2.
Plans:
· The dimensions on the ground sign detail provided are virtually illegible. Please submit a
legible copy for review.
. The ground sign must be accompanied by a landscaped area equal to or greater than the
sign area. Please submit a detailed Landscape Plan for the sign. Provide two copies to my
attention for the file, and send a third to the attention of Scott Brewer, the City's Urban
Forester, at the same address.
. The temporary construction sign illustrated on Sheet C-4 exceeds the maximum height
allowed for such a sign under Ordinance. The maximum height permitted is eight (8) feet.

O'Charley's res~urant is very much looking forward to becoming a part of the Carmel community. The
Carmel store will be the 164th in the O'Charley's chain, and one of only three in the country with this
particular configuration. As part of the Merchants' Pointe development, O'Charley's has worked closely
with the Linder Company and the ADLS board to design a project that fits well within this shopping
center as well as the surrounding neighborhood. Part of this overall plan includes monument .signage
for the outparcels along 116th street. We feel that the overall layout of the three outparcels on the
street, utilizing landscaped parking islands, lends itself well to the placement of signage for each
outparcel, thus providing all tenants with equal opportunity for recognition by the public. I believe
that even some members of the ADLS board have expressed their agreement that regularly spaced and
uniformly designed monument signage would be consistent with the quality of development.
At present, O'Charley's is restricted to only having the two building signs because of the number of
street fron~ges the building has. We feel that it is a reasonable accommodation to our client to allow a
third sign in the form of a monument sign, given the reasons set forth above. We respectfully request
that the board grant this petition for the construction of a monument sign.

Docket No. V-99-01 has been assigned to the Developmental Standards Variance petition filed by Roy Wi lams on behalf
of O'Charley's for Merchants' Pointe, Lot 2. The filing fee for this petition is $630.00.
The petitioner must prepare and file Findings-of-Fact for the petition by noon, Friday, September 14, 2001. The petitioner
is responsible for bringing seven (7) collated copies of the Findings-of-Fact and Ballot Sheet for the Board's use the night
