HomeMy WebLinkAboutDept Report ~J Bauer Commercial- VAG Honda (V-lOO-Ol; V-I0I-01; V-I02-01; V-I03-01; ~04-01) Petitioner seeks the following Developmental Standards Variances of the Sign Ordinance: V-JOO-OJ Section 25. 7.02-7(b): Number & Type 5 Identification Signs V-JOJ-OJ Section 25. 7.02-7(c): Maximum Sign Area 80-square-foot wall sign V-J02-01 Section 25. 7.02-7(c): Maximum Sign Area 52.57-[/] ground sign V-J03-0l Section 25. 7.02-7(c): Maximum Sign Area 105-[1] wall sign V-J04-0J Section 25. 7.02-7(d): Maximum Height of Ground Sign 8' 9" sign The site is located at 4100 East 96th Street. The site is zoned B-3/Business. V-I00-0l - Section 25.7.02-7(b): Number & Type - Petition to allow five SpeCial Use Signs. In deciding whether or not the applicant has presented sufficient proof to permit the granting of a variance of development standards, the Board shall determine in writing that: 1. The approval will not be injurious to the public health, safety, morals and general welfare of the community; Insofar as the general welfare of the community is defined by the Sign Ordinance (ZO Section 25.7; Z-302), the appropriate number of signs for a single-tenant building is prescribed as one identification sign per frontage (up to three) on a public street. The UAG Honda Used site has frontage on East 96th Street, Lakeshore Drive East, and Bauer Drive East; therefore, it is only permitted three (3) identification signs. Injury to the general welfare would be sustained through the granting of a two additional identification signs without practical difficulty being demonstrated. Furthermore, injury would be done through the granting to the property owner the ability to establish signage that is not permitted other occupants of single-tenant buildings in the community. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner; and It is the Department's opinion that the use and value of the area adjacent to the property will not be affected in a substantially adverse manner by the installation of five identification sign. 3. The strict application of the terms of the Zoning Ordinance will result in practical difficulties in use of the property. There is no evidence to suggest that there is practical difficulty posed by the installation of three (3) identification sign per code rather than five. Page 12 Department Report Board of Zoning Appeals September 24,2001 Page 13 of21 V-IOI-Ol - Section 25.7.02-7(c)(ii): Maximum Sign Area - Petition to allow an 80- square-foot wall sign (Honda logo). In deciding whether or not the applicant has presented sufficient proof to permit the granting of a variance of development standards, the Board shall determine in writing that: 1. The approval will not be injurious to the public health, safety, morals and general welfare of the community; Insofar as the general welfare of the community is defined by the Sign Ordinance (20 Section 25.7; 2-302), the appropriate sign area for a Special Use on property five acres or more in size is prescribed as forty (40) square feet. The appropriate sign area for a single-tenant building identification sign in the given location (101-300 feet from a Non-Freeway; 120 feet wide), however, would be ninety (90) square feet. No injury would be done through the granting to the property owner the ability to establish signage of a size that is permitted to other single-tenant business owners in the community. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner; and It is the Department's opinion that the use and value of the area adjacent to the property will not be affected in a substantially adverse manner by the installation of an 80-square-foot identification sign. 3. The strict application of the terms of the Zoning Ordinance will result in practical difficulties in use of the property. As observed previously, injury would be done through denying to the property owner the ability to establish signage that is permitted other occupants of single- tenant buildings in the community. That being the case, practical difficulty does exist on this site, and an 80-square- foot sign would be within the acceptable size range. V-I02-0l - Section 25. 7.02-7(c)(ii): Maximum Sign Area - Petition to allow a 52.57- square-foot ground sign. In deciding whether or not the applicant has presented sufficient proof to permit the granting of a variance of development standards, the Board shall determine in writing that: 1. The approval will not be injurious to the public health, safety, morals and general welfare of the community; Page 13 Department Report Board of Zoning Appeals September 24,2001 Page 14 of21 Insofar as the general welfare of the community is defined by the Sign Ordinance (ZO Section 25.7; Z-302), the appropriate sign area for a Special Use on property five acres or more in size is prescribed as forty (40) square feet. The appropriate sign area for a single-tenant building identification sign in the given location (5-50 feet from a Non-Freeway; 120-foot frontage), however, would be sixty (60) square feet. No injury would be done through the granting to the property owner the ability to establish signage of a size that is permitted to other single-tenant business owners in the community. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner; and It is the Department's opinion that the use and value of the area adjacent to the property will not be affected in a substantially adverse manner by the installation of a 52.57-square-foot identification sign. 3. The strict application of the terms of the Zoning Ordinance will result in practical difficulties in use of the property. As observed previously, injury would be done through denying to the property owner the ability to establish signage that is permitted other occupants of single- tenant buildings in the community. That being the case, practical difficulty does exist on this site, and a 52.57-square-foot sign would be within the acceptable size range. V-I03-0l - Section 25.7.02-7(c)(ii): Maximum Sign Area - Petition to allow a 105- square-foot wall sign. In deciding whether or not the applicant has presented sufficient proof to permit the granting of a variance of development standards, the Board shall determine in writing that: 1. The approval will not be injurious to the public health, safety, morals and general welfare of the community; Insofar as the general welfare of the community is defined by the Sign Ordinance (ZO Section 25.7; Z-302), the appropriate sign area for a Special Use on property five acres or more in size is prescribed as forty (40) square feet. The appropriate sign area for a single-tenant building identification sign in the given location (101-300 feet from a Non-Freeway; 370-foot frontage), however, would be one hundred five (105) square feet. No injury would be done through the granting to the property owner the ability to establish signage of a size that is permitted to other single-tenant business owners in the community. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner; and It is the Department's opinion that the use and value of the area adjacent to the property will not be affected in a substantially adverse manner by the installation of a 105-square-foot identification sign. 3. The strict application of the terms of the Zoning Ordinance will result in practical difficulties in use of the property. As observed previously, injury would be done through denying to the property owner the ability to establish signage that is permitted other occupants of single- tenant buildings in the community. That being the case, practical difficulty does exist on this site, and a 1 05-square- foot sign would be within the acceptable size range. V-104-01 - Section 25.7.02-7(d)(ii): Maximum Height of Ground Sign - Petition to allow an 8' 9" ground sign. Petitioner's packet materials show a redesign of this sign at eight (8) feet in height. Eight feet is the maximum permitted height for a Special Use ground sign. The redesign makes the Developmental Standards Variance for the height of this sign moot. The Department recommends favorable consideration of Docket No. V- 100-01 only up to three (3) signs. The Department recommends that the petitioner combine two of the three signs on the south facade of the building into a single 90-square-foot sign. and eliminate the third. Once this is accomplished. the total number of signs on site would be three. The Department recommends favorable consideration of Docket No. V- 101-01 for a sign area of up to ninety (90) square feet. in order to allow the petitioner to combine two of the three signs on the south facade into a single identification sign. The Department recommends favorable consideration of Docket No. V- 102-01 for a 52.57-sauare-foot ground identification sign. The Department recommends favorable consideration of Docket No. V- 103-01 for a l05-square-foot wall identification sign. The Department recommends negative consideration of Docket No. V- 104-01 for an 8' 9" ground identification sign. The site is zoned B-3/Business. V-105-0l - Section 25. 7.02-7(b): Number & Type - Petition to allow five Special Use Signs. In deciding whether or not the applicant has presented sufficient proof to permit the granting of a variance of development standards, the Board shall determine in writing that: 1. The approval will not be injurious to the public health, safety, morals and general welfare of the community; Insofar as the general welfare of the community is defined by the Sign Ordinance (ZO Section 25.7; Z-302), the appropriate number of signs for a single-tenant building is prescribed as one identification sign per frontage (up to three) on a public street. The UAG Honda site has frontage on East 96th Street and Bauer Drive East; therefore, it would only be permitted two (2) identification signs. Injury to the general welfare would be sustained through the granting of a three additional identification signs without practical difficulty being demonstrated. Furthermore, injury would be done through the granting to the property owner the ability to establish signage that is not permitted other occupants of single-tenant buildings in the community. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner; and It is the Department's opinion that the use and value of the area adjacent to the property will not be affected in a substantially adverse manner by the installation of five identification signs. 3. The strict application of the terms of the Zoning Ordinance will result in practical difficulties in use of the property. There is no evidence to suggest that there is practical difficulty posed by the installation of two (2) identification sign per code rather than five. V-106-0l - Section 25. 7.02-7(c)(ii): Maximum Sign Area - Petition to allow a 52.57- square- foot ground sign. The approval will not be injurious to the public health, safety, morals and general welfare of the community; Insofar as the general welfare of the community is defined by the Sign Ordinance (ZO Section 25.7; Z-302), the appropriate sign area for a Special Use on property five acres or more in size is prescribed as forty (40) square feet. V-107-0l - Section 25.7.02-7(d)(ii): Maximum Height of Ground Sign - Petition to allow an 8' 9" ground sign. Petitioner's packet materials show a redesign of this sign at eight (8) feet in height. The Department recommends negative consideration of Docket No. V- 105-01. Per Docket No. V-22-00 this site already has approval for four (4) Special Use identification signs. On a site that would otherwise onlv be "permitted Page 17 Department Report Board of Zoning Appeals September 24, 2001 Page 18 of21 , two (2) identification signs. the Department believes that four is more than adequate. and should not be further increased. The Department recommends negative consideration of Docket No. V- 106-01 for a 52.57-square-foot ground identification sign. Since the sign itself should not be permitted. neither should the variance for size. The Department recommends negative consideration of Docket No. V- 107-01 for an 8' 9" ground identification sign. The petitioner's redesign makes the petition moot: and since the sign itself should not be permitted. neither should the variance for height. Page 18
