Frankenberger of Nelson & Frankenberger on behalf of Dan Y Olmg Motors, LLC, for Penske Honda, Building 1, located at 4100 East 96th Street in the Bauer Commercial Park: WITHDRAWN by Petitioner: Docket No. V-13a-02, a Developmental Standards Variance of Section 25.7.02-7(c) in order to establish a l23.5-square-foot Paint & Body Shop sign on the west fayade of the building. The Petitioner Withdrew the petition prior to the Board's making a Motion. Per Article VIII, Section 6, of the Board's Rules of Procedure, a resubmittal of this petition may not appear on an agenda of the Board before June 25, 2002. APPROVED: Docket No. V-13b-02, a petition seeking the Board's approval of the final design of the 90-square-foot wall Identification Sign on the south fayade approved per Docket Nos. V- 100-01 and V-101-01 on September 24, 2001. The Board voted three (3) in favor, zero (0) opposed, thereby approving the petition. When applying for a Sign Permit, please attach a copy of this letter to each application in order to assist the Department's review. The Board voted four (4) in favor, zero (0) opposed, thereby approving the petition. APPROVED with Commitments: Docket No. V-I02-01, a petition to vary Section 25.7.02- 7(c)(ii): Maximum Sign Area of the Sign Ordinance in order to permit a 52.57-square-foot ground Identification Sign on the East 96th Street frontage. The Board voted three (3) in favor, one (1) opposed, thereby approving the petition with the following Commitment, which is to be rendered in writing by your attorney and submitted to the Board's attorney for review prior to recording: · If at any time in the future the sign is required to be moved, the relocation of the sign will be accomplished at the property owner's expense, and the City or any successor unit of government will not be held in any way liable.
