Petitioner seeks Special Use Amendment of the approval granted under Docket No. SU-
7-93 in order to establish three (3) temporary classroom units on 81.66:1: acres. The site is
located at 5535 East 131 st Street. The site is zoned S-I/Residence - Low Density.
1. The Special Use in Flood Plain District, Ordinance Z-160, Section 21.6 as
amended does not apply and all prerequisites have been met by Petitioner.
2. The Special Use will be consistent with the Character and Permitted Land
Use of the zoning district and Carmel/Clay Comprehensive Plan:
The Northview Christian Life Church was originally approved under Docket No.
SU-7-93. The petition to utilize three temporary classroom units for religious
education is consistent with the use of the property for a church. The project is
consistent with the character and permitted use of the district and of the
Comprehensive Plan.
3. The Special Use is physically suitable for the land in question:
The project will require minimal grade changes to accommodate the classrooms,
and no other site suitability concerns were raised by the Technical Advisory
Committee (TAC) during the review process.
4. The Special Use will not injuriously or adversely affect the adjacent land or
property values:
The subject property has been utilized as a church for eight years. Property
values in the area should be protected by virtue of adequate landscape screening
and buffering.
5. The Special Use will not adversely affect vehicular or pedestrian traffic flow,
nor the adequate availability of water, sewage, or storm drainage facilities, or
police or fire protection:
Any increased vehicular traffic flow resulting from three temporary classrooms on
the subject property should be negligible. The property has access to East 131 st
Street, a Residential Parkway, and Hazel Dell Parkway, a Primary Parkway. The
adequate availability of water, sewage and storm drainage should not be adversely
affected by this project. Police and fire protection is adequate.

6. The Board has reviewed the requirements of Ordinance Z-160, Section 21.3
(1-25) as they relate to this Special Use, and does not fmd that those criteria
prevent the granting of the Special Use:
The petitioner has provided sufficient evidence that the requirements of Section
21.3 will be met.
The Department recommends favorable consideration of this petition. The Motion
for Approval should specify the petitioner's requested date of December 31. 2004. for
termination of the use and removal of the buildings.
