the public hearing date~ The certified "Proof of Publication" affidavit for the newspaper must be available for inspection the

SUPPLEMENT TO DEVELOPMENTAL STANDARDS
VARIANCE REQUEST OF GERALD AND EVELYN EASTON
7. Jerry and Evelyn Easton live in a residential area known as the Northwood Hills
subdivision. They have lived there eleven (11) years. The area is an 8-1 residence
district. They presently have twelve (~lIogs which they keep as personal pets in
their house. Many of these dogs were homeless when left with them and in need
of special medical treatment and care. The Carmel ordinance defmes a
cominercial kennel as a location where more than three (3) dogs are kept, but does
not differentiate between the owners of the dogs keeping them for personal reasons
or for profit or commercial uses. Therefore, the Eastons are in need of a variance
to the zoning restrictions which do not allow a "commercial kennel" where they
live.
8. The Eastons have had more dogs than allowed by the ordinance for over nine (9)
years. They have received dog licenses every year for their pets and were not told
by the Trustee's office there was a limitation on the number of dogs they could
have. Their situation is unique and not one contemplated by the ordinance since
they do not have their dogs for commercial or profitable purposes. They have
agreed to erect a privacy fence on their west property line, to not add any
additional dogs and to allow the numbers of dogs to be reduced naturally by
attrition and they have agreed to limit the times of day at which their dogs are
outside in their fenced backyard. The Eastons currently limit the times of day and
the length of time the dogs are outside to minimize the noise.
