Statement of Variance Petitioner, Andrius Doniela filed a Development Standards Variance Application on or about October 30, 2023 seeking a variance to permit an installation of a 5 feet tall wrought -iron fence in the front yard of the property located at 3549 W. 131st Street, Carmel, Indiana 46032, such fence being 30 feet south of the road Right of Way. UDO Section 509(B)(1) does not permit front -yard fences in excess of 42 inches. The 60-inch fence is requested for aesthetics and to be consistent with other wrought iron fencing in the neighborhood. Statement of Support Multiple properties along West 131" Street (Main Street) have constructed decorative, wrought -iron fencing in the front yard of the estate lots. The Petitioner's request is consistent with other fencing in the area, does not damage or devalue adjoining properties and is sufficiently set back from the road Right of Way so as not to interfere with traffic on 131st Street. The lot frontage of approximately 240 feet will create an attractive front elevation after the fence is installed. FINDINGS OF FACT SHEET - DEVELOPMENT STANDARDS VARIANCE CARMEL ADVISORY BOARD OF ZONING APPEALS (Petitioner fills out 1-3, and first 2 blanks) Docket No.: Petitioner: PZ-2023-00245 Andrius Doniela 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The 5 feet tall wrought iron appearing black fence will not obscure motorist vision , will enhance the property frontage appearance. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: Adjoining properties will not affected as many of them have similar frontage fences. 3. The strict application of the terms of the Unified Development Ordinance to the property will result in practical difficulties in the use of the property because: Aestetically, due to the size of the parcel, a 42 inch fence is less functional, does not mirror other area fences. DECISION It is therefore the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
