The applicant seeks the following development standards variance approval:
Docket No. 06110004 V Section 25.07.03-01.e Location of temporary subdivision sign
The site is located at the 13800 block of Laura Vista Dr. is zoned R-l/Residence within the US 431

General Info:
The petitioner seeks variance approval for the location of a
temporary subdivision sign "advertising" the development of
Yorktown Woods subdivision. The Sign Ordinance states that
a subdivision construction sign must be located at the entrance
to the subdivision. The proposed sign will be located along
Keystone Ave., just west of the cul-de-sac of High mount
Court. A temporary sign is permitted for 1 year, and the permit
may be renewed if a certain number of lots remain for sale.
Analysis:
This subdivision is designed to extend from the Laura Vista
subdivision, to promote connectivity between neighborhoods.
As a result, Yorktown woods does not have a 'regular' street
entrance. If the sign were placed on Laura Vista Drive, where
one subdivision ends, and one begins, it would not have very
good visibility. The same goes if the sign were placed at the
east end of Mill gate Drive, which is currently a dead end into
undeveloped land. The purpose of this subdivision
construction sign is to let as many people know as possible
that the Yorktown Woods subdivision is being developed. The
sign has been redesigned to look more aesthetically pleasing,
since it is proposed to be located on Keystone Ave, a highly traveled vehicular corridor.
Findings of Fact:
4) The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: a temporary sign is permitted. It will still be
located on the site, but just where it can actually be seen by passersby.
5) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: a temporary sign is permitted. It will be
located on the site, but just where it can actually be seen by passersby.
6) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the sign will be located between two
subdivisions or upon undeveloped land, where it will make visibility of the sign almost
impossible, making the sign's purpose negated.
Recommendation: The Dept. of Community Services recommends positive consideration of Docket
No. 06100004 V with the condition of a time limit that the variance is effective for as long as the
temporary sign is legally established.
