The applicant seeks the following development standards variance approval: 2. Docket No. PZ-2023-00221 V UDO Section 2.10 Maximum 35% lot cover allowed, 50% requested. The site is located at 411 Guilford Rd. (not in any subdivision). It is zoned R2/Residence. Filed by Kim Factor (Rose), owner. General Info: • The Petitioner seeks approval for a new pergola in the back yard, which will add to the existing lot coverage. • Building permit B-2023-00813 is currently in review for the pergola structure addition. • Proposed Improvement triggers requirement to comply with the Unified Development Ordinance regulations. • A variance is requested to exceed the allowed lot coverage. • The site is not located in any subdivision. • Surrounding this site are single family residential homes. • A Homeowners’ Association (HOA) does not exist. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Lot Coverage - • The UDO allows for maximum 35% lot coverage; Petitioner requests 50%. This is a variance of 15%. • The previous owner had added a circle driveway, walkway, and other improvements, without approval. • The Carmel Engineering Dept. has no concern with the lot cover percentage. Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request, since the Carmel Engineering Dept. has no concerns with the proposed lot cover percentage. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
