The applicant seeks the following development standards variance approvals: 16. Docket No. PZ-2023-00258 V UDO Section 2.10 Maximum 35% lot coverage allowed, 40% requested. 17. Docket No. PZ-2023-00259 V UDO Section 5.02(B)(3) Combined square footage of the Ground Floor of a Private Garage and/or Accessory Building shall not exceed 75% of the Ground Floor Area of the Principal Building; 82% requested. The site is located at 4550 Buckingham Ct. (Brookshire Subdivision, Lot 213). It is zoned R2/Residence. Filed by Shae Wilson, owner. General Info: • The Petitioner seeks approval for a louvred pergola in the back yard near the existing pool. • Variances are requested for lot coverage and for total accessory use/structure square footage. • The site is located in a residential subdivision, and there is an HOA (Homeowners’ Association). HOA approval has been granted. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance requests. Variances Requested: Lot Coverage - • The UDO allows for a maximum of 35% lot coverage in the R2 zone, and 40% is requested. This is a variance for an increase of 5%. • Over the years, the site has had hard surfaces and structures added to it. The proposed pergola will be placed over an area that is currently hard surface, and not green space. • The Carmel Engineering Dept. is supportive of the 5% lot coverage increase; the increase should have a negligible impact on that neighborhood’s stormwater system. Ground Floor Area - • The addition of the louvred pergola to the back yard area causes an increase in the total combined square footage of the Ground Floor areas of all accessory structures and uses. • The UDO requires that the combined square footage of the Ground Floor of a Private Garage and/or Accessory Building shall not exceed 75% of the Ground Floor Area of the Principal Building; 82% is requested. This is a variance of 7%, Remaining Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance requests, since the Carmel Engineering Dept. is supportive and since the HOA has granted approval. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
