CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, NOVEMBER 27, 2023
(V) Monke Residence, Accessory Structure Setback Variance.
The applicant seeks the following development standards variance approval:
18. Docket No. PZ-2023-00260 V UDO Sections 2.08 & 5.02.B Minimum 20-ft rear building
setback allowed, 12-ft requested. The site is located at 3180 Driftwood Ct. (Smokey Ridge Subdivision,
Lot 73). It is zoned R1/Residence. Filed by Aaron & Kyle Monke, owners.
General Info:
• The Petitioner seeks approval for new accessory structures / pergolas/gazebos and a patio in the back yard, to
complement the existing swimming pool.
• Variance is requested for accessory building rear setback.
• A 20-ft wide drainage and utility easement also runs along the rear of the lot.
• The lot is triangular, pie-shaped in size.
• The site is located in a residential subdivision, and there is a HOA (Homeowners’ Association). HOA
approval has been granted.
• Surrounding this site are single family residential homes.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Rear Setback -
• A minimum 20 foot rear building setback is required, and 12 feet is requested.
• This is a variance of 8 feet, or a 40% change.
• A 40-ft wide wooded buffer area is located just to the west of this lot and subdivision, as part of The
Courtyards of Carmel subdivision.
• The improvements will encroach 8 feet into a 20-ft wide drainage and utility easement; however, Consent to
Encroach approval was granted by the Board of Public Works & Safety (BPW), already.
Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request since Consent to Encroach approval has already been
received and there is still adequate buffering/distance between lots.
• The Carmel Engineering Dept. does not have any concerns with the variance request, as demonstrated by the
BPW’s approval of the CTE request, which is administered through the Engineering Dept.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
