The applicant seeks the following development standards variance approval: 19. Docket No. PZ-2023-00263 V UDO Section 2.03 Maximum 35% lot coverage allowed; 44% requested. The site is located at 2614 Towne Meadow Dr. (Estates at Towne Meadow Subdivision, Lot 43). It is zoned S1/Residence. Filed by Nick Kell of Family Leisure, on behalf of Hongmei Nan, owner. General Info: • The Petitioner seeks approval for a new in ground swimming pool and decking in the back yard. • Variance is requested to exceed the allowed lot coverage percentage. • The site is located in a residential subdivision, so there is an HOA (Homeowners’ Association). HOA approval has been granted. • Surrounding this site are single family residential homes and University High School property. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Lot Coverage - • The UDO allows for a maximum of 35% lot coverage in the S1 zone, and 44% is requested. This is a variance for an increase of 9%. • The pool and decking will not encroach into any easements on the lot. • The neighborhood has an overall stormwater drainage system. • The pool pump equipment will have extremely quiet operation. • The Carmel Engineering Dept. has approved the case in ProjectDox, our online plan review software. • The Hamiliton County Surveyor’s Office has approved the case in ProjectDox, our online plan review software. Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request, since it is a fairly small increase in lot coverage, and since the neighborhood has an overall stormwater detention system in place. • The approval statuses of the Carmel Engineering Dept. and Hamiliton County Surveyor’s Office in ProjectDox further help the Planning Dept. to support this variance request. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
