The applicant seeks the following development standards variance approval: 4. Docket No. PZ-2023-00250 V UDO Section 5.39 (I) Sign facing southeast (not toward any street frontage) is not allowed, but requested. The site is located at 1701 E. 116th St. (not in any subdivision). It is zoned B3/Business and Rangeline Road Overlay District. Filed by Warren Johnson of S-Mart Real Estate, Inc. General Info: • Variance is requested for a sign not facing a street frontage. • The Petitioner seeks approval for a BMO Harris Bank wall/logo sign to be placed on a blue panel on the drive thru canopy, located behind the building. • This sign will only be visible from the parking lot area of the bank, which is located behind the building that will be pulled up to the roundabout at 116th St. and Rangeline Rd. • Surrounding this site are commercial uses to the north and east, and residential uses to the west and south. • Prior site approvals: o Plan Commission Rezone – Docket no. PZ-2020-00130 Z: 0 E. 116th Street Rezone o Plan Commission DP/ADLS – Docket no. PZ-2022-00154 DP/ADLS: 116th & Rangeline Redevelopment o BZA Variances – Docket nos. PZ-2023-00016 V; -00025 V: 116th and Rangeline Variances • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Sign Orientation - • Signs must face toward a street frontage; however, this sign is proposed to face southeast toward the parking lot area located at the rear of the site. • The proposed wall sign will be 34.3 sq ft in area (9’11” by 3’-5.5”) and is proposed to be placed on a blue panel on the drive thru canopy structure. • Other signs already approved for the site will face the street frontages of this Corner Lot, which fronts on two street frontages – 116th Street and Rangeline Road. • The building will be a multi-tenant building that will be two stories tall. Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • Planning Staff does not support this sign variance request. There is no hardship. The sign can be made smaller, to be 3 sq. ft. in area or smaller to become an exempt sign that complies with the sign ordinance. • Patrons will already be on the site once they see this sign which is located on the rear portion of the building, on the bank drive thru area structure. If needed, traffic directional signage can be utilized to direct on site patrons to the drive up banking area, and those signs can be at most 3 sq. ft. in area and up to 3 feet tall. Findings of Fact: • The BZA attorney will write up the negative findings of fact. Recommendation: • The Dept. of Community Services (DOCS) recommends negative consideration of this variance request, and with adoption of the negative Findings of Fact to be submitted by the BZA attorney.
