The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The use of the property will remain residential and proposed amendments are consistent with that of the community and home site. The pool will have an automatic pool cover and has a fenced in back yard. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The proposed improvement will increase the value of the subject property and in turn, the adjacent properties as well. The improvement is consistent with other existing homes in the neighborhood. The 6ft white fence will provide privacy for neighbors. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: A strict application of the UDO would prevent the homeowner from being able to install a pool of any type in the back yard due to the footprint of the given home on the property. The proposed improvement will allow the homeowner to utilize the property in a nature consistent with residential property.
