The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: Even with the approval of this variance, the Penn One Eleven Development will be a walkable destination with greenspaces, parks, plazas, and a mixture of uses for people to live, work, and enjoy. It will not be injurious to the public, health, safety, morals, or the general welfare of the community. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The variance will not change the initial overall site plan of the development that was created with input from adjacent landowners and which includes tree-lined buffer areas and walking paths between the development and directly adjacent parcels. Further,the variance will not adversely affect property values because the development will meet city standards with aesthetically pleasing design and layout providing ease of access to the proposed mixed-use development. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: As part of the development, the owner is granting rights of way to the city and these rights of way cause the overall lot coverage to surpass the lot coverage maximum in the UDO.
