Explanation of why variance/waiver is being requested: we have a small yard and for a growing family of 4, to get the most out of our backyard, we decided to get a hot tub/swim spa for fun, relaxation and exercise. With a small backyard, the hot tub/swim spa location is limited by privacy for us and distance from our neighbors and this forces us to add the hot tub close to the house which is an ideal location and will compliment the aesthetics of the house but it will encroach into the rear D & UE easement of the property by about 3'. Unlike a pool, the hot tub is self contained and requires much less maintenance and has a built in cover. We are hoping for a favorable outcome due to our practical and unique constraints. An addition like this will certainly improve property value for our house as well as for our neighbors. As a note, we were misguided by the swim spa manufacturer and various local retailers who told us that a permit was not required and provided us documents to that effort. We were not aware of the UDO restriction for which we are seeking a variance since this is now considered as a pool.
