HomeMy WebLinkAboutPacket for HO 12-12-23To the BZA Officer RE:PZ-2023-00268 V Project brief: We have a small yard and for a growing family of 4,to get the most out of our backyard,we decided to get a hot tub/swim spa for fun,relaxation and exercise.With a small backyard, the hot tub/swim spa location is limited by privacy for us and distance from our neighbors and this forces us to add the hot tub close to the house which is an ideal location and will compliment the aesthetics of the house but it will encroach into the rear D &UE easement of the property by about 3'. Unlike a pool,the hot tub is self contained and requires much less maintenance and has an attached hot tub cover.We are hoping for a favourable outcome due to our practical and unique constraints.An addition like this will certainly improve property value for our house as well as for our neighbours without hindering anyone else’s space. There is still 12’easement which is easily accessible from the road side if necessary for any maintenance without hindrance from the improvements made.The improvement proposed is approved by the HOA along with the Drainage,Eng.works board. 2.The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The proposal will improve the value of the property and will only have a fully portable hot tub which is self-contained so there will not be any adverse outcomes whatsoever. Moreover,the enclosure and additional deck and rear patio makes the backyard a welcoming space and enhances the value of the property along with our neighbours. 3.The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: Use of hot tubs require privacy from the neighbours which limits our location of the hot tub and strict application of terms will defeat the purpose of privacy and noise between out neighbors.We have a small backyard and having some room will help in optimal utilisation of the space to make everything look and feel cohesive.
