Based on Carmel Engineering conditional release of the building permit for the temple,
HCSO will also support the building permit release, knowing the plans will be approved in
a short time period. If you have any questions, please let me know.

This conditional release for the building permit does not grant construction plans
approval and the detention basin outlet pipe CAN NOT be installed until the plans are
approved and a pre-con meeting has been held.with Jerry Liston from our office. If you

Could you send me your comments regarding the Temple electronically so we may speed up the
process of getting the plans completely approved and finish the project from the design
portion?
Also, Greg Hoyes has given verbal approval of the plans. I am trying to get in touch with

hopefully today or this afternoon, since he will be out all next week.

comments to issue related to the plans that I hope can be finished up before the end of
the year with approval the first week in January. With release of the building permit, I
am not expecting the petitioner to have issues with delaying the final approval of the
plans. The work in the right-of-way, which requires final plan approval, will not likely
be able to completed until the Spring anyway given the City's restrictions on paving

Dear Mr. Blanchard:
Please accept this letter from us as attorneys for Shaarey Tefilla Congregation, Inc. (the
"Synagogue") with respect to the landscaping plans for the Synagogue's new location at
approximately 3030 West 116'h Street. We are tendering this letter to you with the understanding
that the commitments concerning the phasing in of the approved landscaping as described in this
letter will be sufficient for you to issue the necessary and appropriate building pernlits to allow
the Synagogue to begin construction. Specifically, the Synagogue understands that Scott Brewer
has approved a phased installation of the landscaping, described as follows:
I. Phase I and Phase III: as shown on Sheet Number LPIOI, to be installed no later than
Spring 2007;
2. Phase II: as shown on Sheet Number LPlOl, to be installed not later than one (I) year
after occupancy of the Synagogue building, or the next available planting season.
Upon your receipt and acceptance of this letter, please issue the appropriate building
permits to our contractor, Smith Development & Construction Company. If you should have any
questions or comments, please do not hesitate to contact me.

have plans to approve. It sounds like the sanitary issues may be what is holding up the
final plans. If that is the case! maybe all the other sheets can be finalized and the
plans we stamp have a not for sanitary approval disclaimer on them. I am currently
waiting on plans from Brent and once we approve them! with all final procedural items
complete! we will release for construction. If you have any questions, please let me
know.

pump and several easements or running South 10001+ with a private grinder pump and an
easement through Bridlebourne and the University. Currently Bridlebourne has requested
that a donation of $75,000 -$100,000 be made for and easement which is not equitable and
the amount of easements required to run East is very time consuming and costly. Therefore
currently we are at a standstill with a meeting to be held on Monday morning. DeBoy has
requested that we give a conditional permit in order for the Temple to install the outlet
pipe for their Dry Detention area. Our hands are really tied on giving a conditional
permit until easements are in place because we still have no actual route to provide sewer
service, but we currently have no issues on the storm being installed unless you have
reservations. Is us not issuing a permit the basis for postponing the construction of the
outfall pipe and if so is this enough to allow the installation? If the Temple would push
forward and construct more than allowed we still have the power of not allowing final
connection due to our inspection procedure. Please let me know if this is acceptable or
what I can do to expedite the process in this rare case. Thank you for your understanding
and we do appreciate other utilities looking out for one another.

The Hamilton County Surveyors Office still has not approved the plans for this project
yet. I have looked through our file and it appears we are ready to approve them but where
waiting on some issue to be worked out with 116th Street ROW. I have contacted the
engineer and requested plans. Please do not allow this to move forward at this time. We
should be able to approve the plans and I will send you an e-mail to release the project,
hopefully early next week.

Fire department still has questions on whether the building has a sprinkler
system, or if the petitioner is agreeable to an additional fire hydrant, if the building
has a fire alarm system, the height and if the building has a basement. Our

Please accept this letter from us as attorneys for Shaarey Tefilla Congregation, Inc. (the
"Synagogue") with respect to the landscaping plans for the Synagogue's new location at
approximately 3030 Westl16'h Street. We are tendering this letter to you with the understanding
that the commitments concerning the phasing in of the approved landscaping as described in this
letter will be sufficient for you to issue the necessary and appropriate building permits to allow
the Synagogue to begin construction. Specifically, the Synagogue understands that Scott Brewer
has approved a phased installation of the landscaping, described as follows:
I. Phase [ and Phase llI: as shown on Sheet Number LP I 01, to be installed no later than
Spring 2007;
2. Phase II: as shown on Sheet Number LPlOI, to be installed not later than one (I) year
after occupancy of the Synagogue building, or the next available planting season.
Upon your receipt and acceptance of this letter, please issue the appropriate building
permits to our contractor, Smith Development & Construction Company. [fyou should have any
