RE: 96tb Street Right of Way Dedication
Dear Board Members:
Mr. William D. Keller ofKES Consultants, representing 4146 E. 96th ST., L.L.C., the owner of
Motorcycles of Indianapolis, bas requested the Board sign the Dedication of Public Right of Way document
presented for approval. This document dedicates additional right of way on that portion of 96th Street that
is contiguous to the south property line of Motorcycles of Indianapolis. This dedication will increase the
total half right of way of 96th Street to 75-feet, wbich meets the City of Carmel and Clay Township 20-Year
Thoroughfare Plan requirements.
On behalf of the City of Carmel, I would like to thank the owners of Motorcycles of Indianapolis for this
Dedication of Right of Way. I recommend the Board accept and sign these documents.

Dear Dick,
Attached is the right-of-way dedication document signed by Mr. Dellen. Please review
and let me know if this document will be satisfactory.
I believe this completes the submittal of all the documents you requedted. The Owner is
anxious to begin construction to maintain his schedule. I will respond to any review
comments immediately in order to continue to expedite our submissions so that a
building permit can be issued at the earliest possible date.

ACCEPTANCE OF DEDICATION & DEED OF PUBLIC RIGHTS-OF-WAY
WHEREAS, the foregoing Grantor having filed with the City of Cannel, Indiana ("City"), its
Dedication and Deed of certain real property ("Property") to the City for the purpose of establishing.
City rights-of-way, which Dedication and Deed is attached hereto and incorporated herein as
Exhibit "A" hereinabove set forth;
AND WHEREAS, the City believes that said fee simple conveyance of property is desirable and
necessary and in the City's best interests;
NOW THEREFORE, the City, by and through its Board of Public Works and Safety, hereby
accepts said Dedication and Deed, and orders that the Instrument of Dedication and Deed described
herein be recorded in the Recorder's Office of the County of Hamilton, State of Indiana, and that
said described real property be, and the same hereby is, declared open and dedicated to the City.

RIGHT OF WAY DEDICATION
A part of Parcel II as described in the in the Warranty Deed in Instrument No. 2001-
32215 as recorded in the Office of the Recorder of Hamilton County, Indiana and as
follows:
A part of the South Half of the Southwest Quarter of Section 8, Township 17 North,
Range 4 East of the Second Principal Meridian in Clay Township, Hamihon County,
Indiana, being more particularly described as follows:
Commencing at the Southwest comer of the Southwest Quarter of Section 8, Township
17 North, Range 4 East, thence North 90 degrees 00 minutes 00 seconds East (assumed
bearing) a distance of 1260.00 feet along the South line of said Southwest Quarter to a
point, said point being also the intersection of said South line and the Southerly
prolongation of the Easterly right-of-way of Lake Shore Drive; thence North 00 degrees
