State explanation of why waiver is being requested: The majority of the site is located with the Floodway and/or
Floodplain, and parking facilities will need to overlap the floodplain areas in order to provide any parking for the market.
State reasons supporting waiver request: The developer will be using a pervious product for parking area to minimize
the impact to the hazard area, and the site is graded such that runoff will flow east toward Little Cool Creek as flooding
conditions subside. The entire area within floodplain limits will be grass or vegetation and is in keeping with the intent of
the ordinance. No structures will be installed within areas that were required to be within the water quality preservation
limits.
