Commitments will be filed in conjunction with this request. The site is located on the east side of Cherry Tree Road, south of 146th Street. Filed by Matthew Skelton of Baker & Daniels, LLP. The applicant is requesting to rezone 20.44 acres from S 1 Residential to S2 Residential for the purposes of platting a proposed subdivision. Please see the informational packet prepared by the applicant for an overview of this rezone. This request is only for the rezoning of this property. If this rezone is approved, the petitioner would return to the Plan Commission for Primary Plat approval. Staff feels that discussing the proposed plat is relevant at this stage. As such the petitioner has included the information for review. This site is located adjacent to Cherry Creek Estates to the south and the proposed Legacy PUD to the east. It is also near the Ashmore and Spring Creek Subdivisions. When these surrounding subdivisions were approved, S 1 had 3 different allowable densities (dependant upon where the site was located within the City). This area of Sl zoning was considered "s I Low Intensity" and had a maximum base density of 1.8 units per acre. These existing subdivisions are zoned S 1 and have 1.8 units per acre. In early 2006, the S 1 maximum density was revised to be 1 unit per acre for all areas of the City. The proposed plat that is being requested (and committed to) with this rezone is compatible in lot size and density with the surrounding plated subdivisions. As proposed this plat would have 1.6 units per acre (S2 allows for a density of 2.4 units per acre). The proposed plat complies with all other aspects of the zoning ordinance in terms of required connectivity and open space. The Department recommends the Plan Commission forward this item to the September 5th Subdivision Committee Meeting for further discussion. \ . . u u ..
