4. Docket No. 06060016 Z: Cherry Tree Grove Rezone
The applicant seeks to rezone 20.44 acres from S 1 to S2 to allow for the platting of 34
residential lots. Commitments will be filed in conjunction with this request.
The site is located on the east side of Cherry Tree Road, south of 146th Street.

The applicant is requesting to rezone 20.44 acres from S I Residential to S2 Residential for the
purposes of platting 34 residential lots. Please see the informational packet and committee
supplement prepared by the applicant for an overview of this rezone.
The public hearing was held at the August 15th Plan Commission meeting. Questions raised
included why is there a stub street to the east, why must a path be installed, and how will
construction traffic be routed.
This request is only for the rezoning of this property. If this rezone is approved, the petitioner
would return to the Plan Commission for Primary Plat approval. Staff feels that discussing the
proposed plat is relevant at this stage. As such the petitioner has included the information for
reVIew.
This site is located adjacent to Cherry Creek Estates to the south and the proposed Legacy PUD
to the east. It is also near the Ashmore and Spring Creek Subdivisions. When these surrounding
subdivisions were approved, Sl had 3 different allowable densities (dependant upon where the
site was located within the City). This area of S I zoning was considered "S 1 Low Intensity" and
had a maximum base density of 1.8 units per acre. These existing subdivisions in this area are
zoned S I and have 1.8 units per acre. In early 2006, the S I maximum density was revised to be
1 unit per acre for all areas of the City.
The proposed plat that is being requested (and committed to) with this rezone is compatible in lot
size and density with the surrounding plated subdivisions. As proposed this plat would have 1.6
units per acre (The petitioner is requesting a rezone to S2 - which allows for a density of 2.4
units per acre). The proposed plat complies with all other aspects of the zoning ordinance in
terms of required connectivity and open space.

The following items were requested to be presented at this meeting:
1. The definition of Conservancy Lot (from the Zoning Ordinance) and how it is being
applied with this proposal:
ZO 7.12.02 (6) Non-Common Private Ownership (Conservancy Lots). - Up to
50% of the Standard Open Space Requirement (SOSR) may be included within one or
more large "conservancy lots" of at least three acres provided:
a. A maximum of 75% of each lot area may be applied to the SOSR;
b. The open space is permanently restricted from future development;
c. The Director is given the ability to enforce these restrictions.
2. Petitioner was asked to explore better design options for the lake - in regards to
making it a more natural shape. A square pond is not the best aesthetic option.
3. A schematic layout for lot 34 (the proposed conservancy lot).
4. Proposed lot and street lines overlaid on an aerial image to identify tree conflicts.
5. Architectural standards list.
6. Full size plat for easy review.
Staff has no outstanding concerns with this rezone given the proposed commitments. At the
primary plat filing there may be additional staff, Engineering, and Urban Forrester comments.
The Department recommends the Subdivision Committee forward this item to the full Plan
Commission with a positive recommendation after all comments and concerns are fully
addressed.
