While we generally SUDDort this request by CR White Development & RDJ Homes for a
propo~ed subdivision known as Cherry Tree Grove, we have the following concerns:
I). As Homeowners at 14320 Cherry Tree Road, which is located just South of this
property, we are concerned about the leeway inherent in the proposed S 2 zoning.
What are the density maximums allowed by this zoning? Why is a change from
S 1 necessary for this subdivision?
2). Also, the Carmel portion of Cherry Tree Road (14100 to 146000 blocks) is a
I' narrow, twisty, rural road on which 20 single family homes on large wooded lots
:: are located. Cherry Tree Road has already been negatively affected by the
increased traffic from Pulte's Cherry Creek Development (300 plus homes)
which currently opens onto Cherry Tree Road in two locations which you approved.
Cherry Tree Grove, as planned, would add 50-60 vehicles to the daily traffic
: on rural Cherry Tree.
3).While we might be able to live with this increased traffic, the portion of this
Plan that we strenuously object to is the access road into the adiacent Droposed
400 acre+ Legacy development to the East. While we understand the Plan
Commissions desire for connectivity of neighborhoods, opening up an access
~. to this huge Legacy development would potentially put an unreasonable amount
, of traffic on Cherry Tree Road. If you are insisting on a connection we would
suggest that you make it a walking & lor biking path. This would be in keeping
! with the current designation of Cherry Tree Road as a Biking Route. You already
i have an existing alternate access to this proposed subdivision for emergency fire
i and medical vehicles.

While' we are not looking forward to 30+ homes occupying the land currently holding
two (2) homes, we do feel that, with the above limitations, this Cherry Tree Grove Plan

could rork.
It is our hope that these issues will be seriously considered by the Plan Commission as

they discuss the change of zoning and site plan for Cherry Tree Grove.

RE: Docket No. 06060016Z: Cherry Tree Grove Rezone
We would like to show our support to CR White Development, LLC and RDJ
Homes in their request to rezone the 20.44 acres just south of our property. The
plans ifor Cherry Tree Grove would affect us more than any other homeowner
due t~e amount of footage that our five acres has in contact with this planned
subdivision.
Althoqgh we would prefer not to have this area developed at all, the proposal
that CR White Development is suggesting, will enable Cherry Tree Road to
remain the tree-lined, quaint street that it has always been. They have assured
us that the majority of the existing trees will remain and we are confident that
their interests lie in protecting this natural area.
We ask that the Carmel Plan Commission approve CR White Development's
request to rezone this area from 51 to 52 and submit the request to the Carmel
City Council for final approval. We also ask that the Carmel Plan Commission
review the site plan for Cherry Tree Grove and approve it in a timely manner.
Several of our neighbors with small children would like this project to begin this
winte~ so that the dust, noise, truck traffic etc. would be completed prior to next
spring/summer. This would also be advantageous for the numerous bicyclists
that use Cherry Tree Road on a daily basis.

My name is Dean Graham and my wife's name is Rhenda. We are writing this letter in regards to the
Cherry Tree Grove rezone request that is on the docket tonight (#06060016 Z). We have a few issues
with this subdivision that are more concerns or questions than complaints.

First off is the amount of open/green space that is being set aside. On the site plan there is a 3.3 acre
lot (lot 34) that is shown as conservancy lot. This is being sold to a private individual as private
property and there is no public access to this lot. There is a small area for public use that is shown for a
pond and gazebo/park. If you remove this private lot from the total acreage, the amount of open/green
space is incredibly small for the density of houses being placed in this area.

The second cbncern is more of an understanding of the official guidelines that are to be followed when
asking for a rezoning as is being done here. It is our understanding that adjoining properties 2 levels
deep must be notified for this type of request. It is our belief that the owner of the property directly to
the north ofthis subdivision is in the process of negotiating with this developer to provide them with a
financial gain hnd potential future sale. As a result we believe additional neighbors should have been
notified. So the question we have is, is it common for a developer to buy positive opinions from the
surrounding neighbors by providing financial gains? By buying or negotiating to buy an adjoining
property it seems to be circumventing the system that is in place.
As we stated before we are not complaining with this letter, but just trying to gain knowledge and
understanding 'on how things work.

2. Please provide additional information on materials to be used for the sign, and any
additional plantings or landscaping within the eyebrows.
3., Please provide information on the nature of the proposed commitments.

met on thisl application. The resubmitted materials should include edits addressing the above
