Noted in Metro this a.m. that BZA approved this project with contingencies. Paper stated that they could begin business at
the site immediately. I did not place them on the 2/6 BPW because I did not anticipate that they would be approved at this
BZA meeting. They require BPW approval for conversion from a residential to commercial curb cut. They will also require

Dear Mr. Sanders:
Our office has reviewed the revised site plan filed by yourself on January 15, 2002, for
property located at 140 First Street Northwest. Because this is the third version of your project
proposal that we have reviewed, and it does not appear from the documentation provided that
you will be able to meet the City's Development Standards, the Department will be making a
negative recommendation on this project to the Board of Zoning Appeals for the following
reasons:
1. The parking requirement cannot be met in the area proposed. The southeastern space
appears to obstruct the sidewalk along First Street Northwest, and the northeastern is inaccessible
due to the presence of a Silver Maple.
2. The landscape requirement of a "D" bufferyard between single-family residential and
commercial uses cannot be accommodated under the proposed arrangement, nor can the "C"
bufferyard between active recreation and commercial.
3. The limited lot area (-5445 square feet) does not appear adequate to allow you to meet the
Development Standards for a commercial use. _ To date neither a P~king Plan nor Landscaping
Plan have been submitted that demonstrate the ability to meet the requirements.
4. Inadequate right-of-way for commercial use exists on both First Street Northwest (30-foot
existing) and Second Avenue Northwest (IS-foot existing) adjacent to this site. The commercial
right-of way standard in Carmel/Clay is sixty (60) feet. The right-of-way as it exists today is also
substandard for residential development, which requires either forty- (40') or fifty-foot (50') rights-
of-way, depending on certain conditions of service.
To help bring your submittal into compliance with the Ordinance, the Department would
recommend the following changes to improve the project:

1. The conversion of this property should include both Parcel No. 16-09-25-12-01-
031.000 (west half of Simeon Hawkins' Addition, Lot 15) and Parcel No. 16-09-25-12-01-
034.000.
2. The inclusion of both parcels would allow the parking to be removed to the north of
the structure, improving handicap access. This would also allow the First Street Northwest parking
area to be removed entirely.
3. The removal of the existing parking area would open additional space for the
required landscape plantings on the east. Furthermore, the inclusion of the north parcel would
allow the "D" ~~~~e. ~equirements on the north and east and part of the "C" requirement on the
west to be nl@t1~ the ~~ditional area.

Should y~~~sh to pursue the project as proposed, you will need to file Developmental
Standards V arian~es for the landscaping requirements as we have discussed. If it is your intent
not to pave and curb the parking lot, a Developmental Standards Variance petition will need to
be filed for that, as well.
Should you wish to make an attempt to address these site issues, the Department would
recommend a request on your part to Table the Item to the February 25, 2002, meeting of the
Board. In that instance, revised plans should be submitted to the Department no later than
Thursday, February 7, 2002.
After reviewing the Technical Advisory Committee (TAC) Minutes of December 19,
2001, it appears that you may have issues yet to resolve with the Department of Engineering and
the Division of Building & Code Enforcement. Please continue your efforts through these
offices.

Dear Mr. Sanders:
We apologize for the delay in responding to your project, which was on the December 19th, 2001 Technical
Advisory Committee agenda. We offer the following general comments:
1. Jurisdictions:
. Streets - City of Cannel
. Water Mains, Sanitary Sewers, Storm Sewers - City of Cannel. This project may also fall within
the jurisdiction of the Hamilton County Surveyor's Office because there may be a regulated drain
involved.
2. Board of PubIic Works and Safety approval requirements:
. Commercial Curb Cut - Conversion of a single family residence to commercial or retail use
requires Commercial Curb Cut approval from our Board of Public Works and Safety. This
approval refers to the existing driveway serving this structure. The approval process includes a
letter to the Board, in care of this office, requesting Commercial Curb Cut approval. PleaSe
include an 8Y2 x 11 exhibit/drawing, which indicates the building, driveway and adjacent streets
and/or intersections. Please include appropriate dimensions including driveway width, distance of
driveway from intersections and any other pertinent dimensions.
. Additional Water and Sanitary Sewer Availability (Connection Fees) - Conversion of a single-
family residence into a retail/commercial use may require the payment of additional water and
sanitary sewer connection fees. Please provide the following:
Number of chairs and size (square feet) of existing/previous facility.
Number of chairs planned for proposed facility.
I am enclosing a copy of our BPWS meeting dates and agenda deadlines. Please adhere to the
Engineering Department deadlines for submissions to the Board.
Bonding: Requirements
3. Any work planned in the dedicated right of way of any street or alley will require a Right of Way
Permit, which is available through this office. Additionally, a right of way bond is required with the
permit. The bond is a License and Permit type bond and the amount of the bond is based upon the
number of instances of work in the right of way @ $2,000.00 per instance. Ail open pavement cuts in
dedicated streets require Board of Public Works and Safety approval.
General Comments
4. Please provide a drawing of the proposed site, which shows the building, adjacent street(s), existing
driveway and parking area and north direction indicator. The drawing and photos provided with the
T.A.C. handout do not include enough detail.

5. What exterior changes, if any, are planned for this project? Will parking be expanded from what is
now on site? Will there be additional paving? Are there to be any building additions andlor
demolitions?
6. Cannel Utilities may provide a separate review of this project regarding water and sanitary sewer
issues.
The above comments are based upon the Engineering Department's initial review. Please provide our
Department with a follow up letter and revised plans, if any, indicating all revisions. Second and
subsequent reviews will focus only on revised items. It is critical that this office be made aware of all
modifications made on the plans being resubmitted, particularly if any such changes are considered "new"
or fall outside of our initial review. We reserve the right to provide additional comments on this project,
contingent upon submissions resulting from this review letter.

Our office has reviewed the Use Variance petition filed by yourself for property located at
140 First Street Northwest. The following are comments that need to be addressed:
Application:
· The Legal Description of the property in incorrect. Please provide an accurate Legal
Description of the subject property.
· The subject property consists of two Tax Parcels. Please provide information detailing
when Parcel No. 16-09-25-12-01-031.000 (west half of Simeon Hawkins' Addition, Lot
15) was split from Parcel No. 16-09-25-12-01-032.000 (east half of Simeon Hawkins'
Addition, Lot 15). Similarly, please provide information detailing when Parcel No. 16-
09-25-12-01-034.000 was split from Parcel No. 16-09-25-12-01-033.000.
Plans:
-Please provide a dimensioned survey of the property accurately showing the location of all
existing and proposed improvements on site.
· Please prepare an exhibit illustrating:

and include details regarding illumination and placement on site. Any ground sign must be
located a minimum of five (5) feet from either the First Street Northwest or Second Avenue
Northwest rights-of-way. Ground signs may not interfere with comer vision clearance, and
must be accompanied by a detailed landscape plan for an area adjacent to the sign equal to
or greater than the sign are in square footage.

the sooner the petition can be placed on an agenda.

USE. The employment or occupation of a building, structure or land for a person's service, benefit or
enjoyment.
USE, ACCESSORY. A use subordinate to the main use, located on the same Lot or in the same building as
the main use, and incidental to the main use.
USE, CONFORMING. A use of a building, land or premises which does conform to all of the applicable
provisions of this ordinance.
USE, NONCONFORMING ILLEGAL. A use of a building, land or premises existing at the time of the
passage of this ordinance which does not conform to all of the applicable provisions of this
ordinance nor those of any ordinance superseded by this ordinance.
USE, NONCONFORMING LEGAL. A use of a building, land or premises existing at the time of the
passage of this ordinance which does not conform to all of the applicable provisions of this
ordinance but did conform to applicable provisions of any ordinance superseded by this ordinance.
VARIANCE. A modification of the specific requirements of this ordinance granted by the Board in
accordance with the terms of this ordinance for the pwpose of assuring that no property, because
of special circumstances applicable to it, shall be deprived of privileges commonly enjoyed by
other properties in the same vicinity and district.
VIBRATION. Oscillatory motion transmitted through the ground.
VISION CLEARANCE ON CORNER LOTS. A triangular space at the street comer of a comer lot, free
from any kind of obstruction to vision between the heights of three (3) and eight (8) feet above the
established street grade. The street grade is measured at the intersection of the center lines of the
intersecting street pavement, and the triangular space is determined by a diagonal line connecting
two points measured fifteen (15) feet equidistant from the Lot comer along each property line at
intersections of two (2) residential streets or twenty-five (25) feet at the intersection of any other
types of streets.
WASTE, SOLID. All putresible waste in a form other than a liquid, semi-solid or gaseous form, whether
contained in any form or object, and which is not hazardous waste as defined in I.C. 13-7-1-2 nor
waste which contains any biological, chemical, bacteriological, radioactive or any other
contaminant which may be harmful or injurious to the public health, safety or welfare of the
domestic, commercial, industrial, agricultural, recreational or conservation concerns of the City of
Carmel and/or Clay Township and its citizens. This definition is intended to specifically exclude
human bodies and sewage.
WIDTH, PAVEMENT. The actual width of a street surface that includes only the area that is driveable by
vehicles, not including curbs.
WIDTH, ROADWAY. The paved area ofa street measured from back of curb to back of curb.
WIRELESS TELECOMMUNICATIONS SERVICE. Licensed commercial wireless telecommunications
services, including but not limited to cellular, personal communication services (PCS), specialized
mobilized radio (SMR), enhanced specialized mobilized radio (ESMR), paging, and other similar
services that are marketed to the general public. (adopted per Z-320)
WOODLAND, MATURE. An area of plant material covering Y2 acre, or more, and consisting of thirty
percent (30%) or more canopy trees having a sixteen (16) inch or greater caliper, or any grove
consisting of seven (7) or more trees having an eighteen (18) inch or greater caliper. (adopted per
Z-329)

26.4.1 Where required, perimeter buffering shall be located along the side and rear lot lines of a lot/parcel
and shall extend the entire length of the side and rear lot lines.
26.4.2 Where residential or other buildings back onto a public thoroughfare, buffer plantings shall occur
outside of the public right-of-way, per the Tables below.
26.4.3 Perimeter buffering shall not be located within any portion of a dedicated public street right-of-
way, private street right-of-way, or County regulated drain easement.
26.4.4 Existing vegetation may be used to achieve project buffering if:
(a) the vegetation located upon the subject parcel is ofa quality and state of health to achieve
buffering, and,
(b) the vegetation is proposed to be preserved using accepted best management practices for
tree protection during construction.
26.4.5 To determine the applicable bufferyard requirements:
(a) Use the Table for Bufferyard Determination to identify the land use category of the
proposed project use.
(b) Use the Table for Bufferyard Determination to identify the land use(s) of the adjoining
properties, or identify the street classification adjoining the proposed use by referring to
the Official Thoroughfare Plan of Carmel-Clay Township.
(c) Determine the bufferyard(s) required on each boundary (or segment thereof) of the
subject parcel by referring to the Tablefor Bufferyard Determination.
