EXPLANATION OF
DEVELOPMENTAL STANDARDS VARIANCE REQUEST
Applicant requests a Developmental Standards Variance of Section 25.7.02-07(b) of the
Carmel/Clay Zoning Ordinance to allow a third identification sign. Applicant also
requests a Developmental Standards Variance of Section 25.7.02-07(e) of the
Carmel/Clay Zoning Ordinance to allow the third identification sign referenced in the
previous variance request to be located sixty (60) feet from the centerline of 96th Street
instead of the required eighty (80) feet. The addition and location of the third
identification sign will assist motorists in locating where to turn off of 96th Street to enter
Applicant's place of business. This is particularly important for eastbound motorists
turning left. The Applicant agrees to relocate the requested third sign in the event the
City, or another governmental entity having the appropriate jurisdiction, acquires
additional right-of-way for 96th Street.

FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The sion will be constructed on private property. does not obstruct or otherwise neoatively affect the
adiacent public street riohts-of-way and was desioned in a tasteful manner.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The sion was desioned and will be constructed to complement the commercial nature of the surroundino area.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
If the third identification sion was not allowed by the Ordinance. the automobile dealership would not be afforded
the same amount of sions as other automobile dealerships on the north side of 96th Street. east of Keystone
Avenue.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Developmental Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
