FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The siQn will be constructed on private property, does not obstruct or otherwise neQatively affect the
adiacent public street riQhts-of-way and was desiQned in a tasteful manner.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The siQn was desiQned and will be constructed to complement the commercial nature of the surroundinQ area.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
If the third identification siQn was not allowed by the Ordinance, the automobile dealership would not be afforded
the same amount of siQns as other automobile dealerships on the north side of 96th Street. east of Keystone
Avenue.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Developmental Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.

1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The sign will be constructed on private property. does not obstruct or otherwise negatively affect the
adiacent public street rights-of-way and was designed in a tasteful manner.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The sign was designed and will be constructed to complement the commercial nature of the surrounding area.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
If the sign was placed eighty (80) feet from the right-of-way. the sign would not be visible by passers-by on
96th Street.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Developmental Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
