Z-376-02, Lumber Yard Mall Rezone PC Docket No. 2-02 Z (Rezone) The petitioner seeks to rezone the real estate at the southeast comer of 1 st Street SW and 2nd Avenue SW (more commonly know as the Lumber Yard Mall) from 1-1 (Industrial) to C-2/0Id Town. Filed by the Department of Community Services. The Carmel/Clay Plan Commission forwards this ordinance to the Common Council with a unanimous (10-0) Favorable Recommendation (see enclosed certification). The Department recommends that this item be forwarded to the Annexation and Land Use Committee for review and that the Council adopt the Ordinance upon receiving a recommendation from the committee. Rrief description and hackground information: The proposed rezone will make the zoning of this property consistent with the C-2/0Id Town zoning on the property to the north. The property to the north along with this parcel will be developed as part of the Amli Old Town development. The development will include townhomes and apartment lofts that face the Monon Trail (see preliminary plans attached). These will be built with the same design characteristics employed in the Amli Old Town commercial/residential project to the north. A preliminary site plan is attached to this packet. At its regularly scheduled meeting of February 19,2002, the CarmeVClay Plan Commission voted ten (10) in Favor, zero (0) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed Ordinance No. Z-376-02 with a Favorable Recommendation. Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36-7-4- 608(t)(4), the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the Commission.
