The petitioner seeks to convert an existing residence into an office building. The site is
located at 10820 North College Avenue. The site is zoned B-l/Business within the Home
Place District Overlay Zone.

The applicant is requesting approval of a Development Plan and ADLS for the operation of an
office at 10820 North College Avenue. Please see the informational packet prepared by the
applicant for an overview of the site. The Commission may recall that this site was the subject of
a rezone last summer and that there was much discussion regarding the pros and cons of rezoning
the parcel. The Council approved the rezone and the applicant is now returning to request
Development Plan, ADLS, and variance approval to put in place the proposal that was discussed
last year.
The following are the relevant issues:
1. The improvements proposed today by the applicant are minimal. This is in an effort to
ensure that at some point in the future the site would be ripe for redevelopment in full
compliance with the vision identified within the Home Place Overlay. In addition the
Department has shared with the applicant that we will be recommending to the BZA
approval of any variance requests for a limited period oftime to insure redevelopment.
2. The applicant wants to take the existing single family home and use it for his office. It
needs to be understood that the applicant's intent is to create a transitional use of the
property that will ensure future commercial development. At the time, even though it is
under the overlay, the site could have been developed for duplexes. This is not the type
of development desired under the overlay. However, short-term returns could have
dictated this use.
3. The use, as proposed by the applicant, requires additional approval after the DP/ADLS by
the BZA. Variances are necessary for the existing home to be utilized.
The applicant should be prepared to discuss the variance items with the Special Studies
Committee. The Department is in support of a significant level of relief for a limited period of
time to be prescribed by the BZA.
The Department recommends that this item be forwarded to the Special Studies Committee
on February 4th for further discussion.
