The applicant seeks primary plat approval for an 18.75-acre site, to be divided into 16 parcels with one public cul-de-sac access point. In conjunction with this request, the applicant seeks the following waivers: Docket No. 06100025 SW seo Chapter 06.03.07 Cul-de-Sac length exceeds 600 feet. Docket No. 06100026 SW seo Chapter 06.03.21 Request to have one access point for 16 parcels, two access points required for subdivisions with 15 or more lots. . The site is located south of 131 st Street on Towne Road and is zoned S 1. Filed by Matthew Skelton of Baker and Daniels, LLP for 56 Towne, LLC. The applicant seeks to plat 16 lots on 18.75 acres. See the information packet for full details. These items were heard at the November 21 st Plan Commission Meeting. At that meeting no one from the public spoke in opposition. This site is bounded by platted portions of the Village of West Clay on its north and east borders. To the south is Coxhall Gardens. Nearly 2 acres ofthis site lies within a gas line easement. This is not proposed as a gated subdivision. Given the shape of this site, and the surrounding parcels, a secondary access point is difficult. With no feasible stubs for future connections and without room for an additional cut onto Towne Road (which we would not support), the Department is in favor of these waiver requests. The applicant's proposal meets the zoning ordinance in all other regards. These items received a unanimous positive recommendation (4-0) at the December 5th Subdivision Committee with the following commitments: 1. The petitioner will contact Al of the County Parks Dept about possibly placing a marker on lots that abut the Coxhall Gardens, so that property owners do not encroach onto parkland, 2. In the Secondary Plat phase, the exact trail connection location/easement will be platted, 3. The petitioner will add some evergreens to the plantings along Towne Rd., 4. The Cul-de-sac island will be removed, 5. A commitment will be added that there will be no front load garages; only side or carriage load, 6. The petitioner will work with Scott Brewer on saving trees, and a tree preservation plan will be provided, similar to the one for The Village on the Monon - docket no. 06030005 PP. u o The Department recommends approval of this proposal as forwarded by the Subdivision Committee, subject to the above stated conditions. u u ..
