PZ-2023-00091 CA MODIFICATION MADE IN RESPECT OF DOCKET NO. 05010021 SU MODIFICATION OF • • R DEVELOPMENT Martin Marietta Materials, Inc. ("Martin Marietta"), makes the following Modified Commitments concerning the use and development of that parcel of real estate located near the intersection of the northwest corner of 106th Street and Hazel Dell Parkway, in the City of Carmel, Hamilton County, Indiana, which is more particularly described on Exhibit_A_ attached hereto and incorporated herein by this reference (the "Real Estate"). Statement of COMMITMENTS: Martin Marietta hereby agrees that the following sections of the Commitments set forth under Docket No. 05010021 SU are hereby modified as stated below: 1. General Operational Corunitinents (a) Commitment 1(a) is hereby deleted, and the following is substituted in its place: Martin Marietta will develop a sand and gravel operation on the Real Estate to connnence in 2005 and continue for approximately 20 years, depending on market conditions. Provided, however, that this permit shall expire no later than December 31, 2025. (b) The clause "between the months of November through March (except as necessary to construct visual and noise barriers)" in Commitirient 1(d) is hereby deleted. 2. Reports and Permits — Exhibit B in Commitment 2(c) is hereby supplemented with the maps and submittals listed on Exhibit B-1 attached hereto. To the extent of a conflict between a map or submittal listed on Exhibit 13-1 and a map or submittal listed on Exhibit B, the map or submittal listed on Exhibit B-1 shall control. 3. Buffers and Screening — Commitment 6(a) is hereby deleted and the following is substituted in its place: (a) Buffer Size and Location (1) A buffer area of approximately 110 feet in width will be maintained along the northern boundary of the Real Estate located directly south of Lots 53, 109, 108 and 107 of the Kingswood subdivision. (ii) A buffer area of approximately 90 feet in width will be maintained along the remainder of the northern boundary of the Real Estate located directly south of Lots 96 through 106 of the Kingswood subdivision. (iii) A buffer area of approximately 65 feet in width will be maintained along the western boundary of the Real Estate. The position of these buffers shall be measured from the boundaries of the Real Estate as they exist as of the date of these Modified Commitments, and any conveyance of real estate along the boundary of the Real Estate to the owner of a Lot in Kingswood after the date of these Commitments shall not cause a change in the area of the Real Estate that can be used to extract sand and gravel. (b) All landscaping and screening will be completed and maintained consistent with the Landscape Plan Map, a copy of which is on file in the Office of DOGS. 4. The provisions of Commitment 8(d) shall not apply to the real estate located directly south of and within 150 feet of Lots 53, 107, 108 and 109 of Kingswood subdivision. The above referenced commitments are hereby deemed a part of and subject to the same terms and conditions and enforcement rights as are set forth in the Statement of Commitments issued in respect of Docket No. 05010021 SU, recorded June 30, 2005, in the office of the Recorder of Hamilton County, Indiana, as Instrument No. 2005-00040447, as modified by the Modification of Commitments Made In Respect of Docket No. 04040021 SU, recorded June 26, 2009, in the office of the Recorder of Hamilton County, Indiana, as Instrument No. 2009039061.
