CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT

(V) Brentlinger Residence Enclosed Porch Variances.
The applicant seeks the following development standards variance approvals:
10. Docket No. PZ-2023-00296 V UDO Section 3.64 Maximum 45% lot coverage allowed, 47-
52% requested.
11. WITHDRAWN- Docket No. PZ-2023-00298 V UDO Section 3.64 Minimum 5-ft side/rear
setback required, 3- to 5-ft side setback requested. The site is located at 661 2nd Ave NE (CW Weidler’s
Addition, Lot 58). It is zoned R3/Residence and Old Town Overlay – Character Subarea. Filed by David
Brentlinger, owner.
General Info:
• The Petitioner seeks approval for an enclosed porch building addition.
• A variance is requested for exceeding the maximum allowed lot coverage for lots in the Old Town Overlay.
• The site is located in CW Weidler’s Addition subdivision; however, and HOA (Homeowners Association)
does not exist.
• Surrounding this site are single family residential homes.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Lot Coverage -
• The UDO allows for a maximum 45% lot coverage, and 47- 52% is requested. This is a variance of 2-7%.
• The building addition will comply with the required 5-ft side yard building setback.
• It will also match/complement the existing house’s colors and materials.
• The Carmel Engineering Dept. will require the Petitioner to provide on-site stormwater detention OR
payment into the Stormwater Fund. (The Petitioner has opted to pay into that fund.)
Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request, since the Carmel Engineering Dept. has no concerns with
the slight increase in lot coverage and since the Petitioner has agreed to pay into the Stormwater Fund for
Old Town.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request with
the condition of payment into the Stormwater Fund (if not yet done so), and with adoption of the Findings of
Fact submitted by the Petitioner.
