CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, JANUARY 22, 2024
(V) Carlino Residence, Lot Cover Variance.
The applicant seeks the following development standards variance approval:
12. Docket No. PZ-2023-00300 V Silvara PUD Section 6.1 Maximum 50% lot cover allowed
for Bridgecreek Area lots, 53% requested. The site is located at 12183 Hobby Horse Dr. (Jackson’s
Grant on Williams Creek Subdivision, Lot 239). It is zoned Silvara PUD/Planned Unit Development
(Ordinance Z-652-20). Filed by Jim Shinaver of Nelson & Frankenberger, LLC on behalf of Wedgewood
Building Company, LLC.
General Info:
• The Petitioner seeks approval for a new house with attached garage.
• A variance is requested for exceeding the lot coverage percentage allowed by the Silvara PUD ordinance.
• The site is located in the Jackson’s Grant on Williams Creek Subdivision. HOA (Homeowners Association)
approval has been granted.
• Surrounding this site are single family residential homes.

Variance Requested:
Lot Cover -
• The PUD ordinance allows for a maximum 50% lot cover (for the Bridgecreek Area lots), and 53% is
requested. This is a variance of 3%.
• The lot is around 7,890 sq. ft. in area, with a 76.5-ft lot width at the street and a 47-ft lot width at the rear
property line.
• The Carmel Engineering Dept. has no concern with the slight increase in lot coverage; the overall
development has a stormwater quality and stormwater detention plan, designed with low impact design.
Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the lot coverage variance request, since the Carmel Engineering Dept. has no
concerns with the proposed house project and the slight increase in lot coverage.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
