changes. Once these changes have been made and comments addressed,
please produce a Mylar copy (with the surveyors and land owners signatures)
for signature by this Department. 1 digital copy of the plat must be provided
with the Mylar copy, prior to recording, and then 1 paper copy and 1
electronic copy of the scanned, recorded plat must be submitted following
recording of the document. Our approval of the secondary plat (signature)
will be forthcoming upon revision of the plans according to the items listed
above.

were approved under the Ambleside Development Plan PZ-2021-00013. This Sec on 2 plat is the
western half of the approved development plan.

Angie and Caleb,
As discussed with Caleb on the phone this morning, the County Commissioners have decided that they do not
want us to include CA#9 in the plat as was originally agreed and why the Commissioners were included on the
signature page as owners of CA#9. CA#9 is the boundary of the pond in the NW corner of the site. This pond
generally already existed prior to our development and is owned by the County as it was part of the drainage
th
infrastructure related to the 146 Street improvements. Development of Ambleside Section 2 included revising
the general boundary of the pond and enlarging it to accommodate drainage from Ambleside which has all been
approved as shown on the construction plans and constructed. We have, as part of the original agreement with
the county, already completed deeds to create the new boundary for this pond which ownership is shown on the
County GIS.
With all of that in mind, one of the Commissioners has decided they do not want to be part of the final plat. So they
have requested that we revise the legal description of the plat to remove CA#9 and therefore remove their
signature blocks from the signature page. We are in the process of completing that revision to the plat. When done
it will require new signatures from the Planning Director and BPW members. Caleb agreed to put a place holder for
us on the agenda for the 3/20 BPW meeting, but since the BPW already approved the plat and this is just a revision,
we are going to reach out to Mayor Finkam to see if we can get this signed by the members prior to the meeting. We
would also need a new signature from Mr Hollibaugh.
I will keep you updated as we get feedback from Mayor Finkam and make sure to get the revised mylars to Angie for
Mr Hollibaugh’s signature as needed.

Please know that the following item is very urgent for us to release the subdivision for home construction and I
appreciate in advance your immediate attention to this matter.
It has been requested by Hamilton County that we revise the secondary plat for Ambleside Section 2 and we need
your confirmation that the change will not impact your facilities. I have attached the following two documents for
your reference to this e-mail:
1. Page 2 from the secondary plat for Ambleside Section 2 prior to the requested revision.

2. Printout from Hamilton County GIS showing the existing ROW for 146 Street and the pond in the NW
corner of Ambleside Section 2.
As you will see on item number 1, CA#9 of the plat covers the pond in the NW corner of the property which is
County ROW (per item number 2 above). Originally the County was going to sign off on the secondary plat as
owner of CA#9. However, the County Commissioners have changed their mind, and prefer not to sign the plat.
That means we need to eliminate CA#9 from the plat. Therefore, the UE that I have highlighted on item 1 will not be
included in our plat. However, as stated above this area is already County ROW which will allow you access to
install your facilities.
Please reply all to confirm this will not cause a problem for your utility installations in the subdivision.

With the below communication from Duke, you should now have received e-mails from all of the utilities that are
not City or County controlled that serve Ambleside (Spectrum, Duke Energy, Vectren (aka Centerpoint), Trico, and
AT&T) who acknowledged that eliminating the current county owned ROW from the secondary plat is acceptable.
With that in mind we are in the process of revising the plat to change the boundary and label that area as County
ROW. Once complete we will get two new mylar copies to you for the Directors signature. We will then retrieve the
plat from you and seek to secure BPW Members signatures outside of the BPW meeting.

Concerning WO 50330172 for AMBELSIDE SEC 2, my good friend Tim Walters from Platinum Properties called me and
the city has kind of thrown them a curve ball on the pond common area. Where we were coming in from pole 074-676
to feed the backbone. His explanation is a lot better than mine below, but basically its going from easement to county
ROW, if I understand correctly.

your confirmation that the change will not impact your facilities. I have attached the following two documents for

As you will see on item number 1, CA#9 of the plat covers the pond in the NW corner of the property which is
County ROW (per item number 2 above). Originally the County was going to sign off on the secondary plat as
owner of CA#9. However, the County Commissioners have changed their mind, and prefer not to sign the plat.
That means we need to eliminate CA#9 from the plat. Therefore, the UE that I have highlighted on item 1 will not be
included in our plat. However, as stated above this area is already County ROW which will allow you access to
install your facilities.
Please reply all to confirm this will not cause a problem for your utility installations in the subdivision.

Easements are only needed for a specified use of private property by other parties. Utility companies are allowed to
utilize public right of way for provision of their services. So, the exact same space as what would have been provided in
the common area will remain available for utilities.

Yes, the intent is for the HOA to maintain the area including the turf, native grasses, and aerators with the
exception of the storm structures similar to all other RDE’s within the subdivision.
Also, since this is county ROW, the D&UE’s are really not necessary either.
With that in mind, is the City comfortable with us moving forward removing this area from the plat?

I discussed this with John. If this pond area is to remain county right of way instead of becoming common
area, we are fine with there not being a BMP easement in place. However, we are concerned about
maintenance since the O&M manual for the project dictates HOA maintenance protocols for the new
pond. Has there been discussion with the county on how the pond would be maintained if not owned by
the HOA?

I also left you a voice mail and would like you to call me. This situation will be much easier to explain over
the phone. The quick summary is the County Commissioners have changed their mind about how we are
handling the dedication of the property around the existing pond in the northwest corner of Ambleside
Section 2 and do not want to be party to the secondary plat any longer. With that being removed it
impacts the BMPE, and I would like to discuss how we can handle that outside of the plat.

As discussed with Caleb on the phone this morning, the County Commissioners have decided that they
do not want us to include CA#9 in the plat as was originally agreed and why the Commissioners were
included on the signature page as owners of CA#9. CA#9 is the boundary of the pond in the NW corner of
the site. This pond generally already existed prior to our development and is owned by the County as it
th
was part of the drainage infrastructure related to the 146 Street improvements. Development of
Ambleside Section 2 included revising the general boundary of the pond and enlarging it to
accommodate drainage from Ambleside which has all been approved as shown on the construction
plans and constructed. We have, as part of the original agreement with the county, already completed
deeds to create the new boundary for this pond which ownership is shown on the County GIS.
With all of that in mind, one of the Commissioners has decided they do not want to be part of the final
plat. So they have requested that we revise the legal description of the plat to remove CA#9 and therefore
remove their signature blocks from the signature page. We are in the process of completing that revision
to the plat. When done it will require new signatures from the Planning Director and BPW members.
Caleb agreed to put a place holder for us on the agenda for the 3/20 BPW meeting, but since the BPW
already approved the plat and this is just a revision, we are going to reach out to Mayor Finkam to see if
we can get this signed by the members prior to the meeting. We would also need a new signature from Mr
Hollibaugh.
I will keep you updated as we get feedback from Mayor Finkam and make sure to get the revised mylars
to Angie for Mr Hollibaugh’s signature as needed.
