The site is zoned R-2/Residence within the Old Town Character Sub-area. Filed by Matt Stark for Mr. & Mrs. Hall. General Info: Thc owner is proposing to upgrade his woodshop into a gucsthous¢ with a kitchen and bathroom. By changing the use of' this accessory building, it would have to comply with the Accessory Building requirement that a gucsthous¢ must be located on a lot not less than one acre in area. This parcel is .26 acres, about a quarter of an acre. Analysis' The creation of a guesthouse will be an amenity to the property ~ind to Old Town, adding to its character and charm. If approved, the owner will work with the Department of Building and Code Enforcement to bring the structure up to code for a guesthouse. The Department has concerns of it becoming a possible rental; the petitioner should present evidence that it will not be used as such. Finding of Fact: 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: the structure currently exists as a woodshop, and it will be upgraded to include a kitchen and bathroom to become a guesthouse. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the structure currently exists as a woodshop, and it will be upgraded to include a kitchen and bathroom. This upgrade will create an amenity for the owner and the neighbors. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The strict application of the Zoning Ordinance may result in practical difficulties in the use of ~ the property, due to fact that the owner will not be able to upgrade his accessory building into a better use. Recommendation: The Department recommends positive consideration of Docket No. 04110019 V.
