standards you list appear to be more restrictive that what the UDO actually
allows. Is this on purpose? For example. you list 40-ft rear yard setbacks
instead of 20-ft...

Yes. The setback requirements listed on sheet 1 are
correct. These are per commitments that run with this
site that were previously agreed to and recorded.

What will the gate look like that will be added to the westernmost boundary
of Block B (the private street)? (The Landscape Plan states that the existing
entrance gate at that location will be relocated to the new entrance, so what
will go in its place?)

Yes. The current entrance gate will be relocated to the
western road connection. Extra fence panels similar to
that along the frontage of ditch road will replace where
the existing gate is located. Apologies for not being

We would like to know how the water directed to this pipe currently will be
handled during construction. Will a temporary swale be graded across the
site to allow the water to continue to flow from west to east? Or will the
existing pipe remain until the the new pipe run is installed and tied into the
system? Please clarify.

Per our email conversation on 1/17/24, the drainage along this property line
was to be investigated and revised to provide relief to the adjacent property

Thank you for adding the swale in the rear of the lot but
it appears that the west side of lot 44 is directed across
the middle of the lot and through the building pad. I
have discussed this with the City Engineer and he will
require that these grading issues be resolved prior to
plan approval in order to avoid any significant drainage
redesign during the building permit process.

graded towards the development. A Swale has been

It appears that the existing grading to remain is draining
to the area that has been reported as an existing
drainage issue. To achieve positive drainage away from
the proposed lot pad and eventual home, it will need to
be demonstrated that no portion of the lot outside the
limits of the tree preservation will drain in that direction
and facilities will need to be shown and installed.
Otherwise, the development will need to provide a
drainage outlet for the adjacent property that will help

The land onsite is to be undisturbed. Lot 32 of Deerfield
has a small depression on their property that holds
water before it can drain north to the existing ditch. We
are not responsible for improving their property with
this development. However, developer has been in
contact with adjacent neighbors and we'll work with
them to the best of our ability within our site limits to
improve their current drainage conditions. This
development is increasing the allowable flow into the
outfall pipe for Deerfield. which should improve drain
down time of the ditch.

The Emergency Flood Routing Plan shows assumed
proposed elevations after a home would be
constructed. Plot plans for these custom homes would
have to ensure that the flood routing path would be
unobstructed. The Site development plan and other
sheets shows the neceessary grading for install of

The area noted is a localized low point. It is proposed to
do the same ponding it would be today, but there
would be an inlet provided to push water out faster
instead of ponding on whatever structure it goes to
today. We cannot berm the proposed grade to contain
this flood routing within our property limits without
damming up the neighboring offsite flow. By putting an
inlet here, we would be improving the ponding that
already occurs.

that the addition of the rear yard swale will improve the
drainage for this lot after the home is built if the berm is

With these all be custom homes and some having
walkout basements such as Lot 45, we have added
denoted a front MLAG/MFFE based on 15" above the
curb elevation and a rear MLAG/MFFE based on 2 feet

Both water quality units are located within C.A. #6 which
is denoted as a BMPE. WQ Str. #600B is adjacent to
roadway that is within an I.E.E. WQ Str. #611B is
adjacent to 10' asphalt path for access. Path is within
C.A. that is entirely a BMPE so access is there for the
City.

In order to build the subdivision for custom lots, the
limits of disturbance only show areas to be disturbed for
install of utility and road infrastructure. Individual plot
plans will provide additional limits of distrubance for
each platted lot. Contours shown around pads on
sheet C210 are shown to reflect the eventual grading of
a home on each lot for emergency flood routing around
said homes. These are not shown on sheet C200 as
they will not be graded in this manor as part of
development phase.

The smaller pond is not interconnected with the larger
pond. According to aerial imagery from Carmel's GIS,
2001 Photography shows construction of the clubhoues
on this property. There are no distrubed paths between
the two ponds, therefore we do not believe they are
interconnected. We have also had survey crews onsite
to collect data on every pipe entering the pond and
none show connection to the smaller pond.

Please regrade the area to remove this hill along the
property line between 44 and 45. Currently it is pushing
drainage into both lots and directing it through both
building pads which will create issues during the
building permit process. It appears that several old
storm pipes under the hill are to be removed and one
new pipe is proposed under it so we foresee the area
being heavily impacted during demo and construction
and don't understand why it would be reinstalled.

We believe that the addition of the rear yard swale will
improve potential drainage problems with draining the
berm around the home. The new swale's inlet and pipe
is sized for both lots 44 and 45 to fully drain into.

Please adjust limits of disturbance to the edges of the tree preservation
easements
The previous section of Asherwood attempted to preserve areas on the lots
that were later graded during the home building process. This type of
disturbance needs to be reflected on this set of plans to avoid conflict during
the home building process.

hopefully this voids any issues during the home building
process. Construction limits shown to the western line of

These lots should be graded similar to Lots 43 & 42, where there are clearly
established side yard swales and delineation of the watersheds. Lot 44
should have a side yard swale along the western limits of disturbance to
avoid any potential for discharge to the west in the event that the proposed
building pad is built at a higher elevation than the western limits. There
should also be a general plan in place to handle drainage between Lots 44
and 45 in lieu of a mound, as currently shown. We understand that there will
be some variation between the current grading plan and the final custom
home site layout, however, as discussed at the 5/15/24 meeting, there needs
to be a general grading plan that lays out the overall plan to drain runoff
away from the future homes. Lots 44 and 45 currently show drainage being
directed through the building pads, which will not be acceptable. Please also
refer to Ref.# 56.

The grading for these two lots have been revised. A
swale has been added to the west side of lot 44,
draining to STR. 610. This swale is encompasses in a 10'
D.E. per our 8-8-2024 meeting. The side yard between
lots 44 and 45 has been revised to split the mound into
two, and lower the peak elevation of this mound. The
side yard now serves as a proper outfall for the future
home to drain into assuming the MFFE elevation is met.

100-year storm
Dear Mr. Kashman,
On behalf of Asherwood Carmel, LLC, we would like to request a waiver to Stormwater Technical
Standard Section 302.06 (1.) requiring the detention facility shall be designed in such a manor that a
minimum of 90% of the maximum volume of water stored and subsequently released at the design
release rate shall not result in a storage duration in excess of 48 hours from the start of the storm
unless additional storms occur within the period. In other words, the design shall ensure that a
minimum 90% of the original detention capacity is restored within 48 hours from the start of the
design 100-year storm. The storm design for this project utilizes an existing pond on the project site
with a larger offsite area entering the site than onsite acreage. The proposed design also accepts
onsite watershed from an existing pond in the northeast corner. Due to the limited release rates with
the depressional storage analysis of the existing pond, this standard cannot be met without permitting
greater release rates. The downstream system also throttles this system as the “Deefield Legal Drain”
is inadequately sized for the total watershed draining to the drain. Therefore, we respectfully request
a waiver from this requirement to restore 90% of the volume within a 48 hour time frame from start of
100 year storm. Thank you.

whichever is shorter. The swale of question is located on the south side of lots 44 and 45. This swale
crosses two residential lots and approaches 475 feet. With the redirection of the legal drain in this
area, and dealing with the existing legal drain, it is difficult to route an inlet in order to meet this
standard. This swale will only be collecting minimal flows from the rear side of the future homesites.
Therefore, we respectfully request a waiver from this requirement to increase the maximum swale
length from 300 feet to 475 feet. Thank you.

Dear Mr. Kashman,
On behalf of Asherwood Carmel, LLC, we would like to request a waiver to Stormwater Technical
Standard Section 302.08 (1.) requiring that all swales with less than a 1% bottom slope be required to
install subsurface drains. The swales of question are located on the west side of lot 43 and the north
side of lots 42 and 43. There is an existing swale on the north line of lots 42 and 43. The developer
would prefer to keep a portion of this existing swale (105 L.F.) undisturbed. As we are requesting to
leave this area undisturbed, the swale on the west side of lot 43 does not have an adequate outfall for
SSD. The west swale’s slope has been increased to the maximum it can be (1.31%) while still
considering existing grades and emergency flood routing. The existing swale on the north side of lots
42 and 43 has an average existing slope of 1.54%. Therefore, we respectfully request a waiver from
this requirement to exclude the need for SSD under these two swales. Thank you.

I moved the ADA ramps so I think we will be ok on the ADAs. Not sure if it is perfect, but think it is our best
location. We should be able to manage around them.
As far as the detail goes, our walk will empty out onto the extension of Royalton that is just west of our gate. It will
still be on our property as we are trying to not encroach onto the existing road and property in Deerfield. I see our
curb on south side abutting the curb on Royalton. We would have a ramp down through a depressed curb.
Does that make sense??

Here is a snippet of the gate area. The idea is to have a 20’ access gate to Royalton in order to save the large grove of
pine trees on northside of our road. Our proposal is to not run the sidewalk on the north side of the road for that
reason. We would extend the south side walk to the gate area and allow for a handicap ramp and access to the west of
the gate thus allowing a free flow for foot traffic. As we mentioned, there are no walks in the Deerfield subdivision so
there is no way for us to connect anywhere at this time.

I didn’t see that you attached an annotated exhibit as you described below. Only our exhibit was
attached. However, we seem to not be on the same page here. When we had our meeting at your office we described
that the legal drain we were vacating was only the furthest upstream portion of the drain and that portion of the drain
was not taking on any more water from anything beyond our site. Our proposed development would now accept any of
this said watershed into our private storm system. So there is no need to relocate any legal drain pipe. Just abandoning
the furthest upstream portion of it as shown hatched in red on this exhibit. Please confirm if you agree this is only a

I just want to reiterate that the existing 36” is a separate system from the legal drain.
We will be vacating the legal drain to the next downstream structure as shown with the red hatching.
Does the 36” need to be platted within an RDE? This 36” takes the offsite from Deerfield to the pond within the project.
This, again, is separate from the legal drain. We will be relocating the 36” pipe north closer to the road so it can continue
what it does today. Does this relocated 36” pipe need to be within an RDE? If so, we will follow the guidelines in Sam
message below.
We would prefer for this pond and drainage system to be private instead of county regulated.

Hi Brett. I spoke with Kent and we have established that the hydraulics are fine by us as long as the reasoning is that the
10 year cannot be met without sizing the orifice to be smaller than what is allowed. Please add the hypothetical calcs for
the 4 inch orifice to the drainage report if you haven’t already. As for the reconstruction/vacation question, our issue is
with a regulated drain outletting into a private development, not the other way around so we will be requiring a
reconstruction with this one. Let me know if you have any questions about the approval process.

Hi Brett. I spoke with Kent and we have established that the hydraulics are fine by us as long as the reasoning is that the
10 year cannot be met without sizing the orifice to be smaller than what is allowed. Please add the hypothetical calcs for
the 4 inch orifice to the drainage report if you haven’t already. As for the reconstruction/vacation question, our issue is
with a regulated drain outletting into a private development, not the other way around so we will be requiring a
reconstruction with this one. Let me know if you have any questions about the approval process.

Thank you for these revisions. When the plans are submiƩed, please provide the following:
1. A cross-secƟon of the swale that shows the limits of the naƟve vegetaƟon and locaƟon of “no mow, no spray”
signage.
2. A detail for the “no mow, no spray” signage.
3. A rock chute should be installed where the swale meets the pond to avoid erosion. Please provide a detail for
this as well.
4. Please clarify which planƟng list will be used. There are several “stormwater wetland” mixes included on C334
but we will need to know which one is being proposed.

Thank you for the feedback. For the vegetated swale, can you please confirm if the attached plan sheets have
enough information for approval? We have not shown a vegetated swale in Carmel before.
We will remove pipe run 620-619 and directly discharge the swale into the pond. There is no retaining wall in this
area. The swale cuts over the existing legal drain, but still maintains 2.0’+ of cover over the existing pipe.
O&M Manual will be updated with a revised BMP location map and will include pages also included on sheet C334.

We looked through the revised plans and waiver request with the City Engineer and provided our responses to each
below:
1. We will not support the waiver request to remove the water quality aspect of this storm run. If the water quality
unit will not be installed, a vegetated swale BMP or alterna Ɵve will need to be included prior to the storm run
discharging into the pond.
2. We will only support the proposed swale length exceeding the maximum allowable length if a vegetated swale
BMP is installed prior to the storm run discharging into the pond.
3. Thank you for revising the berm. This should work for the civil plan approval but we will take a close look at
these lots when building permits are submiƩed to ensure that the drainage is acceptable.
4. Thank you for including this swale to take drainage from the lot into the system.
5. We will support the waiver to exclude the SSD on lots 42 and 43 as requested.

grading. The storm profile 604-600 is properly sized in these plans.
Below are some bullet points and responses from our 8-8 meeting as a refresher.
- STR. 620 WQ unit
o We are requesting a variance for this standard. Variance included at the link below.
- Max length of swale
o We are requesting a variance for this standard. Variance included at the link below.
- Grading for lots 44 & 45.
o The berm has been split into two separate smaller berms each entirely located on either lot 44 or
45. There is a lower side yard that the future homes can grade into, similar to the side yards of lots
46 & 47.
- West swale for lot 44.
o A swale has been added in a 10’ D.E. drainage to structure 610. This was to create a defined
channel so the future home would not directly discharge to the neighbor to the west.
- Lots 42 & 43.
o We have gotten additional topo done for the existing swale on the north side of these lots. We have
revised the proposed plan accordingly to match this new data. There is 105 L.F. of existing swale
that the developer would prefer to stay existing. The average slope in that segment is 1.54%.
o We are requesting a variance for not having SSD under the swales(West swale of lot 43 & Existing
swale). The variance is included at the link below.
