The applicant seeks the following development standards variance approval: 5. Docket No. PZ-2024-00003 V UDO Section 5.02 (B)(3) Combined square footage of the Ground Floor Areas of a Private Garage and/or Accessory Buildings shall not exceed 75% of the Ground Floor Area of the Principal Building; 140% requested. The 1-acre site is located at 1717 W. 136th St. (not in any subdivision). It is zoned S1/Residence. Filed by Greg Turner of Start to Finish Landscaping on behalf of Krystin & Kevin Sheridan, owners. General Info: • The Petitioner seeks approval for a proposed open air pavilion with roof, in the back yard. • Variance is requested for exceeding the maximum allowed total floor area for all accessory buildings and uses on the site. • The site is not located in any subdivision; and, an HOA (Homeowners Association) does not exist. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Accessory Structure Ground Floor Area - • The UDO requires that the Combined square footage of the Ground Floor Areas of a Private Garage and/or Accessory Buildings shall not exceed 75% of the Ground Floor Area of the Principal Building; and 140% is requested. This is a variance of 65%. • The 22’ x 26’ pavilion will have siding that will match the house, and the roof of the pavilion will be gabled. The roof material will also match the house. • The side setbacks from the property lines will be around 44-ft and 61-ft, and the rear yard setback will be around 121-ft. • The site already has an attached garage and a mini barn on the site. The pavilion will add to the total square footage of cumulative accessory structures/uses. Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request, since the site is 1 acre in size and the pavilion setbacks will be more than adequate. • On a separate but related note, when the building permit for the house came through (B-2022-00191), the Petitioner paid what it would cost to install the 10-ft wide multiuse path along their street frontage into the Thoroughfare Fund. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
