The applicant seeks the following development standards variance approval: 6. Docket No. PZ-2024-00017 V UDO Section 5.09 Maximum 3.5-ft and 6-ft fence heights allowed, 8-ft requested. The site is located at 30 Twinshore Ct. (Woodland Springs Subdivision, Lot 30). It is zoned R1/Residence. Filed by Katherine Foley, owner. General Info: • The Petitioner seeks approval for a wooden privacy fence on a Corner Lot. • A variance is requested for exceeding the maximum height for a fence. • The site is located in Woodland Springs Subdivision; HOA (Homeowners Association) has been granted. • Surrounding this site are single family residential homes. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Fence Height - • The site is a Corner Lot with two street frontages and two front yards. • The UDO allows for maximum 3.5-ft and 6-ft fence heights, and 8-ft is requested. • The maximum fence heights allowed along the side and rear property lines is 6-ft, and 8-ft is requested. • The maximum allowed fence height in the front yard is 3.5 feet, and 8-ft is request (but it will be setback back approximately 35 feet from the street right of way of Lakeshore Drive West. When a fence is located within the building area (for a building), then it can be up to 9-ft tall. • The west fence segment will be set back and align with the house’s west setback/façade. The north fence segment will run along the north property line, not abutting any street. • The fence will be vertical wooden slats, in a shadowbox design. Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request, since the fence will be setback from the street and will not cause any vision clearance issues. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request and with adoption of the Findings of Fact submitted by the Petitioner.
