Dear Ms. Solada:
At the meeting held Monday, October 23, 2006, Carmel Advisory Board of Zoning Appeals took the following action
regarding the Development Standards Variances (V) filed by you for the property located at 4102 W. 96th Street.
APPROVED Docket Nos. 06090013 V - 06090019 V: Development Standards Variances for parking lot pole light
height, foot-candles at property line, total number of signs, fa~ade projections/recessions, building material/EIFS,
windows-design, and windows-percent of fa~ade.
DENIED Docket Nos. 006090021 V and 06090022 V: Development Standards Variances for south bufferyard
reduction and perimeter parking lot plantings.
No-Decision Vote (2-2) Docket Nos. 06090020V and 06090023 V: Development Standards Variances for northern
bufferyard reduction and screened parking within front/side yard. (Per the BZA Rules of Procedure, these items will
now be placed on next month's BZA agenda (November 27) in order to be re-heard and re-voted upon, so that there
is an actual vote for or against the variance requests, and not a "no decision vote". )
Please be advised that per Section 30.05.05: Time Limit of the Zoning Ordinance, the aforementioned Development
Standards Variance approvals are valid for one (1) year. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must have
been received and approval granted by this Department. The expiration date of the approval is October 23, 2007.
Please be advised that per Section 25.07.07: Sign Permits of the Zoning Ordinance, the signs approved pursuant to
the aforementioned Development Standards Variances must be established within one (1) year. The expiration date
of the approvals is October 23,2007. Sign permits will be required before the signs are installed.
Wben applying for applications for permits regarding tbe improvements contained witbin tbis approval,
please include a copy of tbis letter witb your application materials in order to assist tbe Department's review.
