This means that you will have to resubmit a special use application if you want to pursue this special use request again. Please let me know if you will be presenting your petition at the Jan. 22 BZA meeting. If not, let me know if you would like to table the item, or if you request the Board continue your item. You may run the risk of having your item withdrawn from the agenda completely by the Board, which means you would have to re-do all public notice if you wanted the item to be placed back on the agenda. Below is an excerpt of the BZA Rules of Procedure regarding tabling an item. BZA Rules of Procedure, Article VII, Section 6-7: Section 6. (a) If only a majority (3 out of 5 members) of the BZA are available to hear any agenda item, thereby requiring that the petitioner receive an affirmative vote from all members present in order to prevail, the petitioner may request that the BZA table his or her agenda item once, with the reasonable expectation that more members will be available at the next meeting. In order to exercise this option, however. he or she must request the tabling prior to the start of the hearing of that agenda item, by informing the Chairperson. (b) If the petitioner wishes to request a tabling for any other reason, he or she shall inform the Administrator not less than five days prior to the meeting. However, the BZA shall grant a petitioner only one tabling under this paraQraph Cb). unless the petitioner aQrees to provide new notices of the public hearing as required by Article VI of these Rules of Procedure. (c) This section does not prohibit a petitioner from withdrawing his or her agenda item less than five days prior to the meeting at which it is to be heard. However, any item so withdrawn must then be re-filed with the BZA, and the petitioner must provide new notices of the public hearing as required by Article VI of these Rules of Procedure. (d) Whenever the BZA grants a one-time tabling under paragraph (a) or (b), public announcement of the change of hearing date at the originally scheduled meeting will be deemed sufficient notice to all parties. Section 7. (a) The BZA, at its own discretion, may continue or postpone the hearing of any agenda item upon the affirmative vote of a maiority of the members present. Such a continuance or postponement will not be considered a tablinQ requested or otherwise caused by the petitioner. Do you and your client intend to present this project, again, at the Nov. 27 BZA meeting to seek a vote, or would you like to table the item, or withdraw it? The proposed project falls in the unincorporated area and MS4 jurisdiction of Hamilton County. 2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone. 3. The proposed project is surrounded by the Shelbome Green Regulated Drain Watershed and the Fitch & Jessup Regulated Drain Watershed. It appears the intent is to outlet this site into the Shelborne Green Watershed thru the Shelbome Green Regulated Drain that is near the property line. The pond outlet to the Shelbome Green Drain will become part of the Regulated Drain and further details will be provided at the construction plan stage. 4. In reviewing the current layout of this site. it is noticed the pond is placed at the higher end of the site. which may create design challenges due to the inverts of the existing outlet points this site may drain to. This area all naturally drains to the south and the existing inverts get deeper as the pipe system runs south. Please coordinate with our office to locate an acceptable outlet and see what existing limitation the current system may impose. 6. Please submit complete construction plans and drainage calculations to this office when they become available. 7. Please note that further comments may be necessary at a later date.
