The construction component of the Stormwater Pollution Prevention Plan includes stormwater quality
measures to address erosion, sedimentation, and other pollutants associated with land disturbance and
construction activities. Proper implementation of the plan and inspections of the construction site are
necessary to minimize the discharge of pollutants. The Project Site Owner should be aware that
unforeseen construction activities and weather conditions may affect the performance of a practice or the
effectiveness of the plan. The plan must be a flexible document, with provisions to modify or substitute
ractices as necessary.

2 Sequence describing stormwater quality measure implementation relative to land disturbing
activities
3 Stable construction entrance locations and specifications (at all points of ingress and egress)

The post construction component of the Storm water Pollution Prevention Plan includes the

RE: Hazardous Tree Removal on Smalstig Property
Dear Mr. and Mrs. Smalstig:
On September 13, 2004 a contractor (MacMulch, Inc.) hired by Platinum Properties, LLC. under my
direction removed a large walnut tree from the south edge of your property that was located approximately
10' north of your south property line and 210' east of Cherry Tree Road immediately adjacent to and
outside of the south east corner of your existing 3 rail wooden fence. In my opinion the tree posed a
hazard to the future homes to be constructed in Cherry Creek Estates that will border the same property
line. The tree was not healthy with a large portion of the trunk being hollow (NOT of veneer quality) and
had evidence of limbs 'having fallen from the tree in the past. If limbs from this tree or the entire tree were
to fall in the future on homes in Cherry Creek Estates, liability for damage caused would fall on the owner
of the tree. Therefore, in my opinion, the best option to minimize any expense to you would be to remove
the tree while clearing operations were underway on our site. However, I should have spoken to you first,
and I did not.
In order to make reparation for nO,t speaking to you first and in response to your e-mail dated 9/17/04
(received on 9/20/04), we will complete the following:
1. We will return the sections of the tree to you for your use. I will meet with you to verify the
specifics of the return of these sections prior to them being delivered.
2. All remaining debris and any other trees that were damaged due to this work will be cleaned up to
your satisfaction, and the stump will be ground to grade. I will also meet with you prior to this work
commencing.
3. We will provide and install three 7' serbian spruce trees on your property around the location of the
removed walnut tree to be consistent with the buffer landscaping to be planted on the Cherry
Creek Estates perimeter.
4. We will proceed with the installation of the 3 rail fence as previously committed.
Mr. Smalstig, throughout the entire approval process we have worked with you and Mr. Lunik in good faith
and with serious consideration to your concerns and requests (i.e. extension of utilities and protection of

existing buffers}. While we understand your disdain regarding the unfortunate incident with this tree, I
hope you understand and respect our intentions.

The City has reviewed your comment letter and revised drawings dated May 21,2004 based upon the City review of
April 20, 2004.
The comments from the City review have been satisfactorily addressed with the following exception:

I. Comment from previous review: "Will the Surveyor's Office allow this encroachment?" Your response was
"A Non-Enforcement was submitted to the surveyor for the encroachment." Please provide documentation to
this office that the encroachments created by the basketball court, playground, and pedestrian access
easement into the legal drain easement have been approved by the County Surveyor's office.
Based on additional review, the City provides additional comments:
1. Curbs at entrance in right-of-way (assuming Wildcat Drive is public) need to be curbed to City standards. Is
it possible to install larger radii at entrance?
2. If Wildcat Drive is a public street, please provide the following pavement section detail for any pavement in
the right-of-way: 1" #11 surface on 5" #5D base on 7" #53 stone.
The above comments are based upon the Engineering Department's second review of the Amenity Area. Please
provide our office with a follow up letter and revised plans (revised plans will not be necessary if the encroachments
are approved) indicating all revisions. If you have questions, please contact me at 571-2441.

We have reviewed the initial construction plans submitted for this project and offer the following comments:
GENERAL INFORMATION
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:

I am also enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for
your use. Please use the Engineering Department deadlines for submissions to the Board.
Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and/or the
Board of Zoning Appeals (if applicable) and completion of review by the Technical Advisory Committee.
All written requests to be placed on the Board's agenda must include the appropriate Docket Number and
the date (or dates) of approval by the Plan Commission ami/or the Board of Zoning Appeals (if
applicable). '
4. T.A.C. Review/Drawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing and be
accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all Engineering Department and Utility Department issues have been resolved. The design
engineer must certify all drawings submitted for final approval. This office will require a minimum of five-
sets of drawings for approval after all issues have been resolved. The drawings will be stamped as approved
and will be signed by the City Engineer and the Director of Carmel Utilities. The Owner will receive one-set
which is to be maintained on the construction site at all times. Carmel Utilities will receive two-sets, our
Public Works Inspector will receive one-set and one-set will be maintained in the Engineering Department
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of way or
dedicated easements will require a Consent to Encroach Agreement with the City of Carmel.'..s Board of

6. Carmel Utilities should be provided drawings for review of water and sanitary sewer issues. They will
provide a separate review regarding these issues.
7. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water main and
sanitary sewer main locations.
8. I am including copies of the following with this correspondence:

9. As your are aware, we have engaged Crossroad Engineers for review of drainage plans and calculations for
all projects submitted to this office for review. We have submitted the extra set of plans and calculations to
Crossroad. We will share their comments when we receive them.
BONDING REQUIREMENTS
10. Individual Performance Guarantees will be required for the following subdivision improvements:
. Streets
. Curbs
. Water Mains
. Sanitary Sewers
. Storm Sewers/Drainage
. Monuments and Markers
. Street Signs
. Sidewalks (builders lot sidewalks and common area/perimeter right of way sidewalks may be bonded
separately).
The amount of the Performance Guarantee is based upon a certified Engineer's Estimate far 100% of the cost
of labor and materials to construct the individual improvements, to be provided by the design engineer.
Please provide detailed Engineers Estimates for each improvement including unit costs, quantities, materials
and types of materials, etc. Upon completion and release of individual Performance Guarantees, a three-year
Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon 15% of the
Performance amount for Streets and Curbs and 10% of the Performance amount for all other improvements.
Performance Guarantees may be Performance or Subdivision Bonds, Irrevocable Letters of Credit or
Cashier's/CertifiedlOfficial Checks. Please reference the enclosures for more detailed explanation of our
procedures.
AVAILABILITY AND CONNECTION FEES
I I. Availability (acreage) Fees must be paid after all other Engineering Department requirements have been
satisfied and prior to start of construction activities (the exception is that you are allowed to move dirt on
site). Availability Fees are based upon total platted acreage for the development at the current rate of
$1,010.00 per acre for Water Availability and $ 1,365.00 per acre for Sanitary Sewer Availability. Based
upon the plat presented with the construction plans, the following Availability Fees would apply:
Section 6A - 13.831 Acres
Water - 13.831 Acres @ $1,OIO.OO/Acre = $ 13,969.00
Sanitary Sewer- 13.831 Acres@$1,365.00/Acre= $ 18,879.00

Connection Fees are currently $1,310.00 for water per single-family residence and $795.00 for sanitary sewer
per single-family residence totaling $2,105.00. Connection Fees are paid when the infrastructure has been
completed, satisfactory test results obtained and the subdivision has been released for permits. Connection
Fees are paid on a ~ basis.

additional Water Connection Fees will be assessed based UpOIl the recommelldation of the

1. This proposed project falls within the corporate limits of the City of Cannel.
2. This proposed project DOES fall within 8 Carmel Wellhead Protection Zone.
3. This proposed project fall in the Emily Vestal Regulated Drain Watershed.
4. Please coordinate the storm sewer design with both the City of Carmel and this
office.
S. Please submit an indirect outlet permit request for the proposed project outlet into
the Vestal Regulated Drain. The forms are available on our website at
