DEPARTMENT REPORT
March 30, 2006
7. Docket No. 06010008 Z: Midtown Village PUD
The applicant seeks to rezone 18.82 acres from IllIndustrail to PUD for the purpose of
creating mixed use development.
The site is located at 510 Third Avenue SW and is zoned IllIndustrial.
Filed by Lawrence Kemper of Nelson and Frankenberger for Centex Homes.
The applicant is requesting approval of a Planned Unit Development to allow the construction of 227
residential units (attached townhome and condo flats) and 13,000 sq. ft. of retail. Please see the original
informational packet prepared by the applicant for an overview of this rezone. The public hearing for
this item was held at the February 21,2006 Plan Commission meeting. This item was heard at the March
7th Committee meeting and was continued to this meeting for further discussion. Since that time the
petitioner has presented staff with a revised PUD ordinance (on March 27). These revisions are currently
being reviewed.
Two items that staff would like to callout at this stage of the process include:
1. Petitioner must commit to required upgrades to any rights of way identified on the
thoroughfare plan that are adjacent to or on the interior of this project. These upgrades can
be constructed or funded (for future construction). The petitioner is required to coordinate
with City Engineering to determine these improvements (or cost thereof), and commit to
construction or funding prior to approval. This commitment must berecorded.
2. The proposed realignment of 3rd and 4th avenues will require the relocation of power lines.
Given the proposed building locations to the edge of the right of way (as desired) this will
require to wires to be buried. This is the responsibility of the developer, not the City.
Petitioner should bring the following information to the committee meeting:
1. Updates on any PUD ordinance revisions and edits that are in response to staff's, the
public's, and the Plan Commission's concerns and/or suggestions.
2. Update on landscape plan approval.
3. Update on all outstanding Carmel Engineering issues. Petitioner has not responded to TAC
comments dated Jan. 6, 2006.
4. Detailed architectural standards for all buildings/areas. These standards must include
roofline, materials, unit and tenant sizes, residential products, etc.
5. Details on proposed traffic flow in and around the project.
The Department recommends that the Special Studies Committee continue the request to the May
4th meeting to allow additional time for the petitioner to resolve all outstanding issues.
