A Motion made Grabow and seconded by York to approve the Oct. 23 BZA Meeting Minutes and Findings of Fact for PZ-
2023-00211 V. Approved 5-0.
Reports, Announcements, Legal Counsel Report, and Department Concerns:

A Motion made by Potasnik and seconded by Grabow to adopt the 2024 BZA Calendar. Approved 5-0.

(UV, V) Nathan Hawkins Addition Lot 4 Use Variance & Variance.
The applicant seeks the following use variance and development standards variance approvals:
2. Docket No. PZ-2023-00229 UV UDO Sections 2.19 & 3.56 Permitted Uses — Single Family
Dwelling not permitted, Single Family Dwelling requested.
3. Docket No. PZ-2023-00230 V UDO Section 5.28 (D)(2) Parking spaces in any business,
industrial, or manufacturing district shall not be located closer than 5' to any lot or parcel located in a
residential district or used for residential purposes, 2' requested.
The site is located at 140 N. Rangeline Rd. (Nathan Hawkins Addition Lot 4). It is zoned B1/Business and Old
Town Overlay, Historic Rangeline Subarea. Filed by Fred Krawczyk of FC Tucker, on behalf of Applegate
Properties LLC.
Petitioner: Fred Krawczyk, FC Tucker
• Last week, with received approval from the Plan Commission for the parcel split
• Lot coverage for the single-family resident will be at 43%, the office building will be at 44%
• Most our concerns we received from City Staff was the amount of available parking
We are requesting an additional curb cut to allow for better parking flow and off-street parking
• We will remove the existing deck, to allow more space between the two parking spaces and building

Department Report: Angie Conn
• Currently this site has an office building and an accessory dwelling unit on the same lot, which is allowed in the
Old Town Overlay district. Since they want to split the lot into two, this triggers the need for the UV for an
accessory dwelling unit on its own lot becoming its own single-family detached home.

• Staff recommends positive consideration of the variance and use variance, as well as the Petitioner addresses all
remaining review comments in ProjectDox.
Board Comments:
John Schuler: Can you explain the additional curb cut? Fred Krawczyk: Since we did the parcel split, we want the
additional curb to cut to allow for the flow -through parking.
Leah York: Will the existing deck be removed? Fred Krawczyk: Correct. This will allow for more parking spaces.
Jim Hawkins: Is it a concern if we approve tonight with remaining review comments needed to be addressed? Angie
Conn: The additional curb cut request will need review and approval from the Carmel Engineering Department.
A Motin made by Potasnik and seconded by Grabow to approve Docket Nos. PZ-2023-00229 UV & PZ-2023-
00230 V with the Condition the Petitioner addresses all remaining review comments. Approved 5-0.
(V) 116th and Rangeline Redevelopment, Sign Variance.
The applicant seeks the following development standards variance approval:
4. Docket No. PZ-2023-00250 V UDO Section 5.39 (1) Sign facing southeast (not toward any
street frontage) is not allowed, but requested.
The site is located at 1701 E. I I6th St. (not in any subdivision). It is zoned B3/Business and Rangeline Road
Overlay District. Filed by Warren Johnson of S-Mart Real Estate, Inc.
Petitioner: Warren Johnson
• 30 years ago, I built a convenience store gas station at this location. My family -owned business is in the process
of redeveloping this site. We have not received any funding from the City.
We have BMO under contract to be one of our tenants. We are proposing to place a BMO sign on the blue blade
canopy in the rear of the building.
s The sign will not be visible from the street, but only to our on -site customers. The sign will not distract any
motorist or obstruct any views.
Public Comments: None
Department Report: Angie Conn
• Once a customer is already here, they will know they are at the BMO site.
• Staff believes the sign is too large for this site. If they can reduce the size to 3 sq. ft. the sign would be allowed.
• Directional signage that is 3 sq. ft. is allowed for this site and drive-thru area.
• Staff recommends negative consideration of this variance request.
Board Comments:
Potasnik: What size sign would be agreeable by the Department? What is the size of the sign they are proposing?
Angie Conn: 3 sq. ft. in size and no sign permit fees are needed for this. They are proposing a 34 sq. ft. sign.
Potasnik: What did signs did your tenant request? Warren Johnson: Staff did not like our initial proposal of having
the sign on the front of the building. Per the sign standards, it met all the requirements, but Staff did not like the use of
blue in the sign. The BMO logo sign with no blue will be placed on the front of the building. We are now requesting this
blue sign be placed at the rear of the building.
Grabow: Will there be a drive -up ATM? How much signage is allowed in the drive -through lanes? Warren Johnson:
Yes, two drive up lanes, one for the teller window and one for the ATM. Angie Conn: The sign standards would apply,
3 sq. ft.
York: I'm failing to see a hardship here, since no one will see this sign until the customer is already at the site. You are
still allowed branding signage within the size that is allowed. I drove the neighborhood behind this site, and you can see
this sign through the trees when the leaves are down. Warren Johnson: This sign will not be illuminated after hours.
