Brief Description of Variance: Variance permitting the clearing of mature woodlands in excess of 15%
In deciding whether or not the applicant has presented sufficient proof to permit the granting of a variance, the
Plan Commission should consider the following:
The grant of a variance will not be injurious to the public health, safety, morals and general
welfare of the community.
The use and value of area adjacent to the property included in the proposed plat will not be
affected in a substantially adverse manner.
The need for the variance arises from some condition peculiar to the property and such
condition is not due to the general conditions of the neighborhood.
The. strict application of terms of the ordinance to the property will constitute an unusual and
unnecessary hardship if applied to the property for which the variance is sought.
The grant of the variance does not interfere substantially with the Comprehensive Plan.
Based on all the evidence presented by the petitioner, I approve of the requested subdivision

Dear Mr. Phillips:
We have reviewed the plans submitted for this project and offer the following comments:
GENERAL INFORMATION
1. The project site is located outside of current City of Carmel Corporate Limits. However, the area
is included within the boundaries of Annexation Ordinance C-21 0, which was approved by
Carmel City Council on August 5, 2002 and should be effective in early January, 2003. The
following comments are based upon the assumption that this area is within corporate boundaries
and is subject to City of Carmel jurisdiction.
2. Jurisdictions:
. Streets and Right of Way - City of Carmel.
. Water, Sanitary Sewers - City of Carmel.
. Storm Sewers/Drainage - Hamilton County Surveyor's Office.
3. Board of Public Works and Safety Requirements:
. Water and Sanitary Sewer Availability
. Temporary Construction Entrance
· Any permanent improvement to be installed within dedicated right of way or dedicated
easements. This approval would require a Consent to Encroach Agreement between the
Owner and the City of Carmel.
. Secondary Plat Approval
I am also enclosing a schedule for Board of Public Works and Safety meeting dates and agenda
deadlines for your use. Please use the Engineering Department deadlines for submissions to the
Board.
Any submission to the Board requires prior approval by the Carmel Clay Plan Commission
and/or the Board of Zoning Appeals (if applicable) and completion of review by the Technical
Advisory Committee. All written requests to be placed on the Board's agenda must include the
appropriate Docket Number and the date (or dates) of approval by the Plan Commission and/or
the Board of Zoning Appeals (if applicable).
4. T.A.C. Review/Drawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing
and be accompanied by a drawing reflecting requested revisions. Final drawings will not be
approved for construction until all Engineering Department and Utility Department issues have
been resolved. The design engineer must certify all drawings submitted for final approval. This
office will require a minimum of five-sets of drawings for approval after all issues have been
resolved. The drawings will be stamped as approved and will be signed by the City Engineer and
Director of Carmel Utilities. The Owner will receive one-set which is to be maintained on the

construction site at all times. Carmel Utilities will receive two-sets, our Public Works Inspector
will receive one-set and one-set will be maintained in the Engineering Department. Please be
advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of way
or dedicated easements will require a Consent to Encroach Agreement with the City of Carmel.
5. Carmel Utilities should be provided drawings for review of water and sanitary sewer issues. They
will provide a separate review regarding these issues.
6. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all
water main and sanitary sewer main locations.
7. I am including copies of the following with this correspondence:
. Subdivision Project Approval Procedures
. Performance Release Procedure
. Subdivision Building Permits
. Permit Data, Contacts, etc.
BONDING REOUIREMENTS
8. Individual Performance Guarantees will be required for the following subdivision improvements:
. Streets
. Curbs
. Water Mains
. Sanitary Sewers
. Monuments and Markers
. Street Signs
. Sidewalks (builders lot sidewalks and common area/perimeter right of way sidewalks may be
bonded separately).
The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100%
of the cost of labor and materials to construct the individual improvements, to be provided by the
design engineer. Upon completion and release of individual Performance Guarantees, a three-year
Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon 15%
of the Performance amount for Streets and Curbs and 10% of the Performance amount for all other
improvements. Performance Guarantees may be Performance or Subdivision Bonds, Irrevocable
Letters of Credit or Cashier's/CertifiedJOfficial Checks. Please reference the enclosures for more
detailed explanation of our procedures.
AVAILABILITY AND CONNECTION FEES
9. Availability (acreage) Fees must be paid after all other Engineering Department requirements have
been satisfied and prior to start of construction activities (the exception is that you are allowed to
move dirt on site). Availability Fees are based upon total platted acreage for the development at
the rate of$I,01O.00 per acre for Water Availability and $1,365.00 per acre for Sanitary Sewer
Availability. Connection Fees are $1,310.00 per single-family residence and $795.00 per single-
family residence. Connection Fees are paid when the infrastructure has been completed,
satisfactory test results obtained and the subdivision has been released for permits. Connection
Fees are paid on a lot-to-lot basis.
PROJECT COMMENTS
10. Concrete sidewalks are now required to be 5-feet wide.
II. The boundaries of the subdivision are unclear. The limits of Section 10 should be clearly
identified.

12. The proposed storm water detention facility should be included in the Section 10 boundary and
labeled as "common area" to be transferred to the ownership of the Homeowners Association.
This will establish clear ownership of and responsibility for this facility as well as to help preserve
it.
13. If Amalfi Drive is not being extended into Section 10, this road should be improved to provide a
vehicle turn around (cuI de sac).
14. Please submit a plat for review.
15. A street name should be indicated.
16. The Village brive and Street "A" intersection should be modified to form more of a T-
configuration.
17. Although the drainage for this project is under the jurisdiction of the Hamilton County Surveyor's
Office, we offer the following concerns:
. Where is the emergency overflow for the detention basin?
. 1 OO-year plan stores water in pipes and swales. Care should be taken to ensure swale banks
are high enough to prevent overflow of 100-year storage volume.
The above comments are based upon the Engineering Department's initial review of this project. Please
provide our office with a follow up letter and revised plans indicating all revisions. Second and subsequent
reviews will focus only on revised items. It is critical that this office be made aware of all modifications
made on the plans being re-submitted, particularly if any such changes are considered "new" or fall outside
of our initial review.

Soils Information:
Brookston silty clay loam- this soil is dark colored, silty in texture and on depressional uplands.
It is deep and very poorly drained with moderate permeability. It has high available water for
plant growth and high organic matter content. It has compact till starting at a depth of 40 to 60
inches. The main soil features that affect the urban development uses are seasonal high water
table, high potential frost action, moderate shrink-swell potential, moderate permeability and
ponded surface water.
Crosby silt loam, 0-3 percent slopes- this soil is light colored, silty in texture and on sloping
uplands. It is deep and somewhat poorly drained with slow permeability. It has high available
water for plant growth and medium organic matter content. The soil has compact till starting at a
depth between 20 -40 inches. The main soil features that affect urban development uses are
seasonal high water table, moderate shrink-swell potential, high potential frost action and slow
permeability .
Additional information about soils is available in the "Soil Survey of Hamilton County". The engineer and/or
developer should consider the need for an onsite soils investigation.

I have reviewed the plans for this project and have the following comments:
. Because of the poorly drained soils the dry basin is going to have a damp bottom.
Recommend more slope be added to the bottom and compensate for lost volume by
increasing the overall size.
. The erosion control plan will be reviewed after the primary.

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the December 18, 2002 TAC meeting. Please feel free to copy and distribute this
email or attach it to your meeting minutes. We have also created a new page on our
website linked to the "Construction" page where we have posted all CTRWD TAC comments from
2001 and 2002 meetings held to date. We will continue to add to this page every month so
please let everyone know they can view our comments online now too.
Village of Mount Carmel, Section 10 (Primary Plat)
The District has not received any plans for this proposal. Building permits should NOT be
issued unless the District has issued connection permits.
Wexley Chase (Primary Plat)
The plans received by the District show the sanitary main lines and manholes, but will
need to be revised to show sewer profiles, manhole, lateral and bedding details. The
District's most recent version of sanitary sewer specifications also needs to be included
on the plans. Revised plans need to be submitted. A preconstruction meeting will need to
be held before the construction of the proposed sanitary sewers. Building permits should
NOT be issued unless the District has issued connection permits.
University High School (Special Use, DSV)
The District has not received any plans for this proposal. Building permits should NOT be
issued unless the District has issued connection permits.
Shelborne Park, Section 2 (Secondary Plat and Construction Plans)
The plans that the District received are in accordance with the District specifications.
Building permits should NOT be issued unless the District has issued connection permits.
West Carmel Center, Block D, Lot 3 - Applebee's (Development Plan)

We have reviewed the construction plans and drainage report submitted to the Hamilton Count)' Surveyor's
office on December 3, 2002. We have the following comments:
1. This site is not aMexed to the city of Cannel, therefore, this will be a Hamilton County regulated
subdivision. A hearing wUl be required before the Drainage Board. The meetings are beld on the
second and fourth Monday of each month. All of me comments will need to be addressed by noon
on the Wednesday before the drainage board meeting.
