The approval of this variance request will NOT be injurious to the public health, safety, morals and general welfare of the community because: The proposed sign will be temporary in nature. Petitioner would propose that the sign be permitted for a period of 18 months with the understanding the Petitioner and Board of Zoning Appeals could review the petition and consider some reasonable extension of time, if needed. The sign can only be seen from the Keystone off-ramp, and unlike the Beazer sign to the south, the viewer will be committed to the "off-ramp" route by the time they see the sign. The Ordinance permits a second construction sign but not at this location since it is not an entry. #2: The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: This proposed sign can only be viewed from the Keystone Off-Ramp and not from residential developments located to the north and east. This includes the new residences of Laura Vista, as a significant mature wooded area serves as a buffer from the off-ramp. ~ The sign is needed to help promote sales of custom homes starting at $500,000. Laura Vista is a high end custom product and the sign will hopefully help accelerate the development and construction of the remaining 41 home sites. In doing so, the "disturbance" to Foster Estates (through which all traffic must travel) will be reduced and ultimately eliminated as construction of new homes ends. #3: The suictapplication of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: Petitioner understood that the location of the site would present some marketing challenges. Petitioner has attempted to market the site and generate traffic via the creation of a website, print media, events, direct promotion to the north side real estate offices, special award winning advertisements and brochures for almost three (3) years. The strict application of the zoning ordinance does not permit Petitioner to place the construction and directional sign on its onlv maior visible street frontage, the Kevstone Off-Ramp. The history of being without such a sign. is well documented in that only 10 lots have been sold during the first three years of existence. ) 3 STATEMENT OF VARIANCE Code Citation: Pursuant to Section 25.07.03 Temporary Signs - City of Carmel Zoning Ordinance; more specifically 25.07.03-01 Subdivision Construction Signs: Laura Vista Subdivision is permitted one (1) sign per entrance. This permitted sign occurs on Laura Drive which is effectively an interior location since one must access the subdivision via an adjacent subdivision, Foster Estates. This is the logical placement for a permanent landscaped entry and permanent sign announcing the subdivision of Laura Vista; however, its highly limited visibility renders it almost useless as a marketing and directional tool. The platting and development of Yorktown Woods to the immediate south of Laura Vista created a second entry on Laura Vista Drive, but again the location is really not suitable for a marketing sign. The Variance Request: Petitioner respectfully requests consideration for the second telllDoran "mllrketinll entrv silln" to be located at the western oerimeter of Laura VISta rather than at the Yorktown Woods entn. This alternative location would permit the sign to be seen from the "Keystone off-ramp". This sign provides some acknowledgement of the development and how one reaches the community from 146th Street. The petitioner seeks to install a temporary ground sign measuring 4 feet x 8 feet on the west side of the custom home subdivision known as Laura Vista. The placement will be at the edge of a Laura Vista Common Area which is densely wooded. The subject sign will likely not be visible even to residents of Laura Vista due to distance and vegetation. 4 STATEMENT OF SUPPORT 1. The subject sign will likely not be visible even to residents of Laura Vista due to distance and vegetation. ) EXHmIT D REASON FOR DEVELOPMENT STANDARDS VARIANCE Laura Vista suffered initially from being limited to one entrance, namely Laura Vista Drive which is an "interior street" within Foster Estates. The Petitioner developed the Laura Vista property into 54 new residential lots and incorporated one (1) existing lot at the request of the City in order to create this new custom home subdivision. The subdivision was platted in 2004. Prior to platting marketing efforts were commenced in an effort to pre-sell some home sites. It was believed that through the creation of high quality marketing materials, personal sales calls on north side real estate offices, high quality print media placements, on-site events and the creation of a new website, that the project could be adequately marketed. Over the last two years, Petitioner has expended considerable money and time but sales absorption has been considerably slower than expected. That marketing effort includes the creation of two (2) furnished models and three (3) speculative homes. Being advised by the City that only one sign per entry was permitted, Petitioner continued to resort to other marketing efforts. The Petitioner believes it has sought to solve the marketing issue through a number of advertising. mediums but with little results. ) Yorktown Woods Subdivision was subsequently developed to the south of Laura Vista and Beazer Homes has recently built a model home and a speculative home. While they have a site that is much more visible from Keystone Avenue and the Keystone off-ramp, shortly after opening their sales center, they recognize the marketing challenge and filed for, and were recently approval for, a temporary ground sign located along the same Keystone off-ramp frontage (Docket No. 06110004 V - Approved Monday, December 18, 2006). Their sign is located further south (Refer to Exhibit E).
