Amendment to the Carmel/Clay Zoning Ordinance & Comprehensive Plan -
Mineral Extraction District
The petitioner seeks to add a new zoning district to the Zoning Ordinance.
Filed by the Department of Community Services.
The City of Carmel and Department of Community Services has initiated the petitions referenced
above in order to address the land use of mineral extraction under a new zoning district
designation. The proposed Comprehensive Plan Amendment and Ordinance Amendment is not
specific to any particular real estate. They establish the basis for regulating mineral extraction
under a district designation and the rules and procedures that would apply to real estate zoned
under the proposed designation.
A property may only be rezoned to the proposed district designation after review and
recommendation by the Plan Commission and adoption by the City Council. Again, these
amendments only address the creation of a zoning district designation, not its application to a
specific parcel(s).
Comments at the Plan Commission on January 21 as follows:
1. Concern regarding proposed setbacks
2. Questions regarding air and noise pollution
3. Concern about homes being for sale longer and not appreciating as fast in Kingswood
4. Desire to monitor progress and increase distribution frequency of information
5. Desire to see all property owners treated equally
6. Concern that mining would be removed as Special Use where it already exists today.
7. Desire to see property values explored
8. Request to see information concerning the Environmental Stewardship Council
9. Concern that the petition not be a de facto rezone.
10. Request for information regarding blasting and its impact on seismic activity.
The Public Hearing was left open and there was a request to place this item at the beginning of
the agenda.
The Department is requesting that the Plan Commission forward this petition back to the
full Plan Commission after all concerns and questions have been addressed.
