ORDINANCE NO. D-2702-24
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AUTHORIZING AND APPROVING AN APPROPRIATION OF FUNDS FROM THE PARKS
AND RECREATION NON-REVERTING CAPITAL FUND (FUND #103)
Synopsis: Appropriates $4.6 million for park capital projects from Local Income Tax (LIT) funds
received from Clay Township attributable to the Central Park Bond.
WHEREAS, the Carmel/Clay Board of Parks and Recreation (the “Park Board”) is a governing
body created and authorized to administer the Carmel/Clay Department of Parks and Recreation (the
“Department”) and parks and recreation programs pursuant to the Interlocal Cooperation Agreement
between Clay Township, Hamilton County, Indiana (the “Township”) and the City of Carmel, Indiana (the
“City”) on July 30, 2002 and effective January 1, 2003, as amended from time to time and fully incorporated
herein; and
WHEREAS, the Township is obligated under the Interlocal Cooperation Agreement to make any
distribution of Local Income Tax (“LIT”) attributable to the bonds issued to finance the original
construction of Central Park (the “Central Park LIT”) available to the Park Board for capital expenditures;
and
WHEREAS, the Township has historically deposited the Central Park LIT within the Township’s
Park Capital Non-Reverting Fund 1215 consistent with the terms of the Interlocal Cooperation Agreement;
and
WHEREAS, the Indiana State Board of Accounts (the “SBOA”) notified the Township that
effective in 2023 all Central Park LIT may only be deposited within and expended from the Township’s
General Fund; and
WHEREAS, as confirmed by the SBOA, the Township may pay the Central Park LIT to the Park
Board and deposit such funds within the City’s Parks and Recreation Non-Reverting Capital Fund (Fund
#103); and
WHEREAS, the City Controller created Cash Account 1103 within Fund #103 to clearly segregate
and track all Central Park LIT funds received from the Township; and
WHEREAS, the Department has identified capital funding needs based on the priorities
established by the Park Board in the 2020-2024 Comprehensive Parks and Recreation Master Plan; and
WHEREAS, the 1103 Cash Account of Fund #103 currently has unencumbered funds from Central
Park LIT in excess of four million six hundred thousand dollars ($4,600,000.00).
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, that the following sum of money is hereby appropriated from the Parks and Recreation Non-
Reverting Capital Fund (Fund #103) and for the purposes specified, subject to applicable laws, as follows:

This Ordinance shall be in full force and effect from and after the date of its passage, signing by
the Mayor, and such publication as required by law.
If any portion of this Ordinance is for any reason declared to be invalid by a court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance
so long as enforcement of same can be given the same effect.
