ORDINANCE D-2704-24 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, REPEALING ORDINANCE D-2409-18, AS AMENDED, AND REMOVING CHAPTER 2, ARTICLE 2, SECTION 25 FROM THE CARMEL CITY CODE Synopsis: Repeals Ordinance D-2409-18, as amended, and abolishes the Carmel Public Art Advisory Committee. WHEREAS, the City of Carmel Common Council (the “Council”) previously established the Carmel Public Art Advisory Committee (the “Committee”) by adopting Ordinance D-2409-18, as amended; and WHEREAS, the Council finds that the Committee’s duties and responsibilities are too limited for the Committee to effectively serve its intended purpose; and WHEREAS, Mayor Finkam indicated to the Council that she intends to propose a different entity with expanded duties and responsibilities to act in place of the Committee; WHEREAS, the Council now finds that it is appropriate and beneficial to the City to repeal Ordinance D-2409-18, as amended, and corresponding portions of the Carmel City Code. NOW, THEREFORE, IT IS AGREED AND ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. Previously enacted Ordinance D-2409-18, as amended, is hereby repealed and the Carmel Public Art Advisory Committee is hereby abolished. Section 3. Chapter 2, Article 2, Section 25 of the Carmel City Code is hereby removed in its entirety. Section 4. All other current provisions of the Carmel City Code Chapter 2, Article 2 shall remain in full force and effect and are not affected by this Ordinance. Section 5. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 6. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor.
