Docket No. 167-02 PV; Part of Walters Plaza Replat (plat Vacation) The applicant seeks approval to vacate a portion of the Replat of Part of Walter's Plaza Replat. The site is located on the north and south sides of Walter Street (Tract "A" and "B" of the Plat). Filed by Michael C. Cook of Wooden & McLaughlin for Metro Acquisitions, LLC. The applicant is requesting that the Plan Commission approve a request to vacate a portion of the Walters Plaza Replat (see exhibit within the information packet distributed prior to the public hearing). The area in question was rezoned as part of the Clay Terrace PUD. It is specifically the location ofthe proposed Range Line Road extension and detention facilities being constructed as part ofthe Clay Terrace development. See previous petition. This request in no way reduces the design and review requirements ofthe PUD. It is similar to the situation addressed earlier this year adjacent to the Lowe's PUD site for the construction of the new ramp off of Keystone. The right-of-way within the subject area will need to be vacated by the City Council. This step would remove the now vacant tracts within the existing Walters Plaza Replat from the recorded Secondary Plat itself. This requires Plan Commission consideration. The Department recommended that this item be approved at the conclusion of the Public Hearing if there are no questions or concerns raised that warrant Committee consideration. The Department assumes due to the fact that there were not comments made at the public hearing directly related to the Plat Vacation that the item was forwarded as a companion to the Preliminary Development Plan for Clay Terrace. The Department recommends that the Subdivision Committee forward this item back to the full Plan Commission with a favorable recommendation after all comments and concerns have been addressed.
